CITY OF EVERETT - BOARD OF ADJUSTMENT <br />ORDER <br />WHEREAS, theretofore, there was filed with the City of Everett <br />Planning Department on (date) April 2, 1974 an application <br />for a variance of Section No. .050 of the Everett City Code No. 15.04 by <br />(applicant) Bill O'Bri <br />(address) 5037 - 33rd Avenue West <br />for. (specific variance requested) <br />a variance from Section 15.04.050 E.C.C. (Zoning Code) General <br />Provisions - Land Use, to permit frontage of two lots on a private road <br />30 feet in width and not abutting a publically dedicated street. Said <br />private road will have access from 33rd Avenue West. <br />i on the following described property: <br />Lots 1, 2, 3, & 4, Block 3, Shore <br />Acres Addition <br />Zoning: R-S, Surburban Residential <br />Address: Approximately 5027 - 33rd Avenue West <br />Everett <br />AND: WHEREAS, (date) May 6, .'.974 was fixed as <br />the date of hearing on said application and proper notice having been <br />given as required by law, <br />AND: WHEREAS, a public hearing was held on said date and the Board of <br />Adjustment, after reviewing all testimony, made the findings that: <br />1. The granting of the variance is necessary for the applicants' <br />enjoyment of his property rights. <br />2. The granting of the variance will not be detrimental to the <br />surrounding area. <br />3. There are exceptional circumstances that apply to the subject <br />property that do not apply to ether properties as Lots B & C cannot be <br />serviced by Alki (Olympic) Drive because of adverse topography. <br />4. The granting of the variance will not be detrimental to the <br />comprehensive land use plan. <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT that <br />said application be GRANTED with the following stipulations: <br />1. There should be legal (recorded) easement for the public utilities. <br />(This has been subsequently verified). <br />2. A covenant for street and easement maintenance will be required. <br />AND: BE IT FINALLY ORDERED that a copy of this written order be <br />transmitted to the applicant for their information. <br />DATE OF ACTION: May 6, 1974 <br />Reiff H.
