Finding No. 1: This lot fronts to the east towards <br />the unimproved right-of-way of 33rd Avenue West. <br />This right-of-way is only 30 feet wide and deadends <br />at the south line of the subject property. There is <br />a large vacant parcel to the east of this lot and if <br />and when it develops, additional right-of-way may be <br />obtained and 33rd Avenue West may be improved. <br />Access to the subject lot is provided via a private <br />road on the north off 33rd Avenue West. The <br />applicant wishes to orient the house to the north <br />towards the private road since it is a view lot and <br />the view is to the north and west. In addition, <br />moving the house further to the east than a 40 foot <br />front setback allows would enhance the view from the <br />home since it would be the highest point of the lot. <br />b. Conclusion U1: There are exceptional <br />circumstances applying to the subject property that <br />do not apply generally to other properties in the <br />vicinity and zone. <br />
