SECTION 01323 <br />NETWORK ANALYSIS SCHEDULES <br />9. It is to be expressly understood and agreed by the Contractor that the Schedule is an <br />estimate to be revised periodically as progress proceeds, and that Sound Transit dens ` <br />not guarantee that the Contractor can start work activities on the "early start" or "late <br />start" dates or complete work activities on the "early finish" or "late finish" date shown in <br />the baseline Progress Schedule, or in an updated or revised Schedule, nor does Sound <br />Transit or Resident Engineer guarantee that Contractor can always proceed in the <br />sequence established by said Schedule. If Contractor's Schedule shows that Sound <br />Transit or a separate contractor is to complete an activity by a specific date, or within a <br />certain duration, Sound Transit or any separate contractor under contract with Sound <br />Transit will not be bound to said date or duration unless Sound Transit expressly and <br />specifically agrees in writing to same; Sound Transit's and the Resident Engineer's <br />review and approval or acceptance of the Schedule does not constitute an agreement <br />to specific dates, durations, or sequences for activities of Sound Transit or any <br />separate contractor. <br />1.06 UPDATES AND PROGRESS PAYMENTS <br />A. The Contractor understands and agrees that its CPM Progress Schedule is intended to <br />accurately reflect at all times the status of the Project construction and projected activities. <br />The Contractor also understands and agrees that updating the schedule is a key component <br />of this requirement and will make every reasonable effort to provide current information. <br />B. The approved CPM Progress Schedule shall be updated monthly and submitted to the <br />Resident Engineer with the monthly progress payment request. <br />The Contractor shall submit updated information by reporting remaining durations and <br />recording actual starts and finishes for each activity. The Contractor shall check the <br />"out of sequence' progress and make the appropriate corrections. The Contractor shall <br />submit the proposed updated schedule information with the new progress percentages <br />noted. The Contractor and Resident Engineer shall meet to review the update. The <br />Resident Engineer must approve the progress percentages. <br />2. The Contractor shall generate computer Schedule Re'ports from the CPM Progress <br />Schedule, based on the updated Schedule. These computer reports shall reflect the <br />progress of the project with respect to time. The Contractor Ehall generate !hese <br />reports for the information and use of the Resident Engineer in reviewing progress. <br />These reports shall include sort by total float by early start, sort by activity number, and <br />out of sequence activity report. The Contractor shall submit to the Resident Engineer a <br />3-%' computer diskette or compact disk containing the latest approved Schedule <br />update data, including the relationship ties, along with a written narrative describing the <br />overall progress of the Work and discussing possible problems, the status of major <br />changes and any changes in sequence. <br />Each month, on the day established in, and in accordance with the requirements of, <br />Section MEASUREMENT AND PAYMENT, the Contractor shall submit its application <br />for progress payment. The Contractor and the Resident Engineer shall review the <br />progress of the Work at the site to confirm that the requested payment is due.
