SECTION 01410 ENVIRONMENTAL REGULATORY REQUIREMENTS PART 1 —GENERAL 1.01 SUMMARY A. General: The list of environmental laws set forth in this section is provided pursuant to Section 39.04 of the Revised Code of Washington. The Contractor shall fully comply with the provisions of such laws as they may apply to the Work. 1.02 LIST OF ENVIRONMENTAL STATUTES, ORDINANCES AND REGULATIONS A. General: The following is a list of Federal, State and local environmental statutes, ordinances and regulations which deal with the prevention of environmental pollution and the preservation of public natural resources that affect or may affect this Project. This list is not to be considered as all-inclusive, nor shall the absence of a law from this list be construed to relieve the Contractor from complying with such law, to the extent it is applicable to the Contractor. Federal Statutes a.) National Environmental Policy Act: Establishes a Federal policy on the environment and requires the appropriate Federal agency, in any Federally assisted or authorized project, to prepare an environmental impact statement for any "mzjor action significantly affecting the quality of the human environment". b.) Clean Air Act: Establishes a Federal policy on air quality and directs each slate to promulgate air quality laws and regulations to achieve the goals set forth in the Act. c.) Clean Water Act: Establishes a Federal policy on water quality and directs each state to promulgate water quality laws and regulations to achieve the goals set forth in the Act. In addition, the Act requires a permit for discharge of pollutants and sets forth oil spill prevention provisions and penalties. d.) Rivers and Harbors Act of 1899: Provides that discharge of refuse without a permit into navigable waters is prohibited. e.) Port and Waterways Safety Act of 1972: Provides vessel design and construction standards to protect the marine environment. f.) Resource Conservation and Recovery Act: Provides standards and requirements for the generation, transportation, treatment, storage and disposal of hazardous wastes. g.) Comprehensive Environmental Response Compensation and Liability Act: Provides standards and procedures for the investigation and remc;jial activities to clean up hazardous substances which have been discharged into the environment.
