Unavoid:�ble Delav <br />1 An unavoid�ble delav means a delav in the prosecution of the Work that <br />cannot be reaarded as avoidable under Paraqraph 10.02C. Unavoidabie <br />de'avs shall include delavs that result from causes bevond the control of <br />the Contractor and that could not have been avoided bv the exercise of <br />care prudence coordination foresiqht. and diliqence on the part of the <br />or miti atina such delav. <br />2 Examples of Unavoidable Delavs include, but are not limited to: <br />a. Acts o( God. <br />b. Fire. <br />c. War. <br />d. Riot. <br />e. Unusuallv Severe Weather. Unusuallv severe weather conditions <br />shafl not be deemed unusuallv severe if thev fail within two (21 <br />standard �ievialions from the mean of data rec.rorded bv the U.S. <br />Weather bureau far the Seattle and Tacoma metropolitan area <br />over the pasl twenly (20) vears. Impacts of or�-qoinq weather <br />conditions shall be updated weeklv bv ihe Contractor and <br />�rovided to Sound Transit. To preclude the difficuities of actual <br />measurement the parties heretc aqree that weather daia a! the <br />Site shall be expresslv deemed io be the same as that measured <br />at the Seattie-Tacoma International Airoort bv the Environmantal <br />Commerce. <br />f. Epidemic. <br />3 Extension of Time: For delavs that the Contracror has niven notice <br />�ursuant to this Section and considers to be unavoidabie, the Contractor <br />sh�ill submit to Sound Transit complete written informati�n demonstratinq <br />the P�fecl of the delav on the crilical Rath on the accepted Construction <br />Schedule. The submission shall be made vrithin ten (10) Davs after the <br />end of the occurrence that is claimed to be responsible fer the <br />unavoidable delav.
