performed by the Contractor or subcontractor under any such <br />contract or any other Federal contract with the same prime <br />contractor, or any other federally-assisted con tract subject to the <br />Contract Work Hours and Safety Standards Act, which is held by the <br />same prime contractor, such sums as may be determined to be <br />necessary to satisfy any liabilities of such contractor or <br />subcontractor for unpaid wages and liquidated damages as provided <br />in the clause set forth abcve. <br />iv. Subcontracts. The Contractor shall inseR in any subcontracts the <br />clauses set forth in this section and also a clause requiring the <br />subcontractors to include these clauses in any lower tier <br />subcontracts. The Contractor shall be responsible for compliance <br />by any subcontractor or lower tier sub�ontractor with the clauses <br />set foRh in this section. <br />J. Material Suppliers. The requirements of this section do not apply to contracts or <br />subcontracts for the purchase of supplies or materials or articles normally available on <br />the open market. <br />III. COMMUNITY REPRESENTATION <br />Sound Transit supports the direct involvement of FAST JOBS Coalition ("FAST") Community <br />Representatives and Agents, referred to as "FJC-Rep" and FJC-As", to ensure the recruitmer.t <br />and successful retention of people of color and women. <br />Sound Transit shall provide to the Contractor the names of FJC-Reps and FJC-As to be granted <br />site access on behalf of FAST. The activities of FJC-Reps and FJC-As shall include but not be <br />limited to: monitoring goals for participation of workers of color and women; suppoRing, <br />mentoring and problem-solving for all workers to promote harmony and safety on the job site <br />and increase retention of workers of color and women; acting as liaisons for workers of color <br />and women to enhance communication and expedite resolution of issues; participating in the <br />implementation of Sound Transit policy; serving as a recruitment resource; and submitting <br />monthly reports to Sound Transit and FAST detailing their activities. <br />Subject to pre-approval from Sound Transit or its construction management <br />representative, the Contractor and its subcontractors shall permit FJC-Reps and FJC-As on <br />the jobsite at all reasonabie times and if the FJC-Rep or FJC-A is a part of the workforce on the <br />project, the Contractor shall not subject them to discrimination or discharge on account of <br />proper FJC-Rep or FJC-A activities. FJC-Reps or FJC-As shall not interfere with the work of <br />employees and shall fully comply with the visitor, safety and security rules established for the <br />Project, and the Gontractor shall report any issues or violations thereof to Sound Transit. <br />IV. JOINT ADMINISTRATIVE COMMITTEE (JAC) <br />Contractors may voluntarily enter into the Project Labor Agreement (PLA), negotiated by Sound <br />Transit and the Building Trades, under which they agree to participate on a Joint Administrative <br />Committee (JAC) to assist the parties to implement and interpret the PLA and promote <br />harmonious relations on the projects.
