II. <br />LABOR COMPLIANCE MANUAL <br />GENERAL <br />A. Insertion of Provisions Into Subcontracts. Contractor shall insert the provisions <br />set forth in this Labor Compliance Manual ("Manual") in all construction <br />subcontracts of any tier. <br />B. Drug Free Wurkplace. <br />Contractor shall comply with applicable Drug Free Workplace requirements as set <br />forth in 49 CFR Part 29, Subpart F, as modified by 41 U.S.C. 702, 49 U.S.C. 5331 <br />and other applicable requirements. <br />In addition to other remedies available to Sound Transit, the Contractor's failure to <br />comply with the requirements of this Section may render the Contractor subject to <br />suspension of contract payment or termination for default pursuant to the veneral <br />Provisions. <br />C. Disputes Conceming Labor Standards. Disputes arising out of terms and <br />provisions of this Manual shall be resolved in accordance with the procedures of the <br />Department of Labor set forth in 29 CFR Parts 5, 6, and 7, the Washington State <br />Department of Labor and Industries, or other applicable procedures. Disputes <br />within the meaning of this clause include disputes between the Contractor (or any of <br />its subcontractors) and Sound Transit, the U.S. Department of Labor, the <br />Washington State Department of Labor and Industries, or the employees or their <br />representatives. <br />WAG�S OF EMPLOYEES. <br />A. General. This Contract is subject to Washington Department of Labor & <br />Industries ("L&I") prevailing wage requirements as well as the federal Department <br />of Labor ("DOL") p�evailing wage requirements. The higher of the two prevailing <br />wage rates will prevail. In the event that a state prevailing rate for a particular <br />classification is available but a federal rate is not available, the procedure <br />outlined below for determination of a federal rate shall be followed. In the event <br />that a federal prevailing rate for a particular classification is available but a state <br />prevailing rate is not available, the procedure outlined below for determination of <br />a state prevaiiing rate shall be followed. The Contractor shall comply with the <br />requirements of both the state L&I and the federal DOL, for posting notices of <br />applicable wages, submission of certified payrolls, record keeping and other <br />applicable administrative requirements. <br />B. Wage and Fringe Rates Escalation. The Contractor and its subcontractors <br />shall adjust the wage rates paid to its amployees twice annually cn the date that <br />the �Vashington State prevailing rate adjustments are effective in March and <br />September. Sound Transit will make monthly progress payments under the <br />Provisional Surn item for Wage Rate Escalation for the actual costs incurred by <br />the Contractor in meeting this requirement on a cost reimbursement basis.
