PLANNING DIRECTOR DETERMINATION <br />Retaining Wall Modification <br />Review Process It #02-003 <br />INTRODUCTION: The City of Everett Planning Department has received an application from Jeff <br />& Caroline Mason, 612 — 34 thStreet, Everett, WA 98201, to replace an existing retaining wall with <br />two new retaining walls. Section 39.150.C.5 of the Everett Zoning Cede grants the Planning <br />Director the ability to permit a retaining wall to exceed the maximum allowable height of thirty-six <br />inches within a setback, using the Review Process as described in the City's Local Project <br />Review and Procedures Ordinance. <br />BACKGROUND: Section 39.150 of the Zoning Code allows rockeries and retaining walls in <br />required building setback areas if the rockery or wall is: <br />a. The rockery or retaining wall is not being used for direct structural support of <br />a building; <br />b. The rockery or retaining wall is reasonably necessary to provide support to a <br />cut or slope; <br />C. The rockery or retaining wall will not obstruct or interfere with the vision of <br />vehicles or pedestrians using the street or driveways; and <br />d. The rockery or retaining wall is not greater than 36" in height. <br />The subject property is located at 6,12 — 34" Street, in the R-1 Single Family Detached Low <br />Density Zone. The property owner has made application for a rockery/retaining wall modification <br />for the placement of two n=w retaining walls within the front and interior side setbacks. <br />FINDINGS: There is an exiting retaining wall on site that is proposed for removal. The proposal <br />:s to install one four foot high retaining wall (Wall 1) adjacent to the front property line, and an <br />additional three foot retaining wall (Wall 2) four feet back from the front property line. The area <br />between the retaining walls would be landscaped with shrubs and groundcover. Wall 1 is being <br />proposed at four feet in height in order to accommodate the change in topography on site. <br />DECISION: The Planning Director has determined to approve the application for the retaining <br />wall modification based on the following conditions being met: <br />• The maximum height of the retaining wall should not exceed 4 feet above the existing <br />grade within any required setback area. <br />This is an administrative decision that may be appealed to the City's Land Use Hearing Examiner. <br />An appeal must be filed with the City within 14 days of the date of this notice.
