The proposal wili not generate nuisance irritants such as noise, smoke, dust, odor, <br />glare, visuai blight, or other undesirable impacts. The proposal is consistent with <br />the Everett General Pian which designates the area as Multi-Family, 20 - 50 <br />dweiling units per gross acre. 't is a nonconforming use and does not conflict wiih <br />other general uses in the vicinity. <br />11 <br />12 <br />The request is consistent with the City's SEPA or3inances. <br />The proposal satisfies all Federal, Stat2, and local regulations. <br />13. A nonconforming use can be expanded not more than 25% of the total area of the <br />property. The proposal of the Applicani will result in an expansion of 6.7% square <br />footage of the existing building. The expansiun is in compliance with the <br />nonconforming use regulations of the Everett Zoning Code. <br />14. The Special Property Use Permit evaluation crteria are the same and the <br />nonconforming criteria. The requested Special Property Use Permit criteria are <br />satisfied by the proposal.. <br />15. No adverse testimony was received at the pubiic hearing. <br />CONCLUSIONS <br />The application is for the approval of an expansion of a nonconforming use and <br />building by the expansion of an 186 square foot addition to a dental cliric at 1426 - <br />35th Street, Everett, Washington. <br />�. The use is a nonconforming use because it is a clinic use in an R-4 Muiti-Family <br />High Density Use designation, and the clinic is not part of a muiti-family structure. <br />The use was in place at the time of the adoption of tne Everett Zoning Code. <br />3. The criteria for review of the expansion of the nonconforming use as set forth �n <br />EMC 19.38.090.A&B have been reviewed. These criteria which are identified in the <br />findings of this document are satisfied. 1"ha manner in which each of the criteria is <br />satisfied is hereby adopted as a corclusion in support or the decision. <br />4. The requested expansion of nonconformin� use does not exceed the maximum <br />permitted area allowed for expansion of nonconforming uses within the City of <br />Everett. The expansion is allowed. <br />
