The proposal satisfies all Federal, State, and local regulations. <br />13. A nonconforming use can be expanded not more than 25°!0 of the total area of the <br />propeRy. The proposal of the Applicant will result in an expansion of 6.7% square <br />footage of the existing building. The expansion is in compliance with the <br />nonconforming use regulations of the Everett �oning Code. <br />14. The Special Property Use PeRnit evaluation criteria are the same and the <br />nonconforming criteria. The requested Special Property Use Permit criteria are <br />satisfied by the proposal.. <br />15. No adverse testimony was received at the public hearing. <br />�?Z`L�IITb��'�� <br />The application is for the approval o�f an expansion of a nonconforming use and <br />bui�ding by the expansion of an 186 square foot addition to a dental clinic at 1426 - <br />35th Street, Everett, Washington. <br />2. The use is a nonconforming use because it is a clinic use in an R-4 Mufti-Family <br />High Density Use designation, and the clinic is not part of a muRi-famiy structure. <br />The use was in place at the time of the adoption of the E� �•^" Zoning Code. <br />3. The criteria for review of the expansion of the nonconfomiing use as set forth in <br />EMC 19.38.090.A8B have �aeen reviewed. These criteria which are identfied in the <br />findings of this documc��i are satisfied. The manner in which each of the criteria is <br />� satisfisd is hereby adopted as a conclusion in support or the decision. <br />4. The requestad �3xpansion of nonconforming use does not exceed the maximum <br />permitted area allowed for expansion of nonconforming uses within the City of <br />Everett. Ttre expansion is allowed. <br />
