All of the exhibits are available for inspection at the Hearing Examiner's O�ce located <br />at 2930 Wetmore A.venue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the Applicant and <br />testimony and evidence elicited during the public hearing, the following Findings of Fact <br />and Conclusions constitute the basis of the decision of the Everett Hearing Examiner. <br />FINUINGS OF FACT <br />The Applicant requested approval of the construction of an addition to the <br />existing attached garages and duplex at 710 — 35�' Street, Everett, Washington. <br />it is the intent of the Applicant to construct an addilional 675 square foot garage <br />and carport to the south of the existing attar,hed garages and duplex on-site. <br />With the addition, the total area of the attacned and detached accessory building <br />area would be 2,354 square feet. (exhibif 1) <br />2. The subject property is zoned R-1, Single-Family Detached Low Density. <br />(exhibit 1) <br />3. Everett Municipal Code (EMC) 19.7.020 sets forth regulations for accessory <br />buildings within the City of Everett. Subsection "H" of this ordinance requires lhat <br />detached accessory buildings shal! not exceed 15 feet in height unless they <br />qualify as an exception under EMC 19.7.020.K. Pursuant to suhsection "K", the <br />He2ring Examiner has aulhority to deny an application for buildings which <br />exceed 15 feet in height or a total of 1,000 square feel, ;f the proposal is <br />incompatible with the dwelling and/or neighborhood character. In making this <br />determination, the Hearing Examiner considers factors such as view obstruction, <br />aeslhetic impact on surrounding properties and streetscape, ircompatible scale <br />with dwellings on the surrounding properlies, and impact on neighborhood <br />character. (exhibit 1, EMC 19.7.020) <br />4. The subject property contains a duplex that has a brick veneer. On the prope�ty, <br />which is 19,600 square feet in area, are attached accessory buildings that <br />consist of 1,679 square feet and also a small 119 square fcot detached <br />acc �ssory building. The attached accessory buildings incl�de a 300 square foot <br />solarium, a 500 square foot garage, a 240 square foot garage, and a 495 square <br />foot R`✓ garage with a 144 square foot art studio on the second floor. (exhibit 1, <br />i:;galsbe tEsfimcny) <br />5. EMC 19.7.020.B limits the combined total square footage of all accessory <br />buildings to 1,000 square feet, provided that up to 500 square feet of an attached <br />garage constructed as an integral part of the dwelling shall be exempted from the <br />calculation of accessory building size. This square footzge limitation maq be <br />exempted subject to the provisions of 19.7.020.K.
