Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a hearing and to issue the decision. That authority is set forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the He•iring Examiner enters the following <br />Conclusions: <br />CONCLUSIONS <br />The Applicant requested approval of the construction of an addition to the <br />existing attached garages and duplex at 710 — 35`� Street, Everett, Washington. <br />It is the intent of the Applicant to construct an additional 675 square foot garage <br />and carport to the south of the existing attached garages and duplex on-site. <br />With the addition, the total area of the attached and detached accesscry building <br />area would be 2,354 square feet. (�nding 1) <br />2. The proposed 675 square foot garage and �,arport would exceed 15 feet in <br />height, but it satisfies the criteria as set forth in EMC 19.7.020 for an exception. <br />Although the structure would exceed 15 fieet in height, it would be compatibie <br />with the existing dwelling, and it would not create a view obstruction, aesthetic <br />impact on surrounding properties and streetscape, or be ;ncompatible with any <br />dwellings on the surrounding properties. It would not have an impact on <br />neighborhood character. (Mdings 7- 13) <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions and testimony and <br />evidence submitted at the public hearing, it is hereby ordered that the requested <br />approval to constr��ct a 675 square foot garage and carport addition on the south of the <br />existing attached garages and duplex located at 710 — 35�' Street, Everetk, Washington, <br />is grantea subject to the following conditions: <br />A covenant acceptable to the City Attorney's office shall be recorded on the title <br />to the property stating that the property owner acknowledges the requirements of <br />this section, and stating that lhe use of any accessory structure is limited to <br />accessory activities permitted by the zone in which the property is located, and <br />that the accessory bui�, �g shall not be converted to living area or used for any <br />purposes which are no; in full compliance with zoning and building code <br />requirements. <br />Jbtain necessary building permits frorn the City of EveretPs Building Department. <br />Compliance with the State Building Code is required. <br />
