� <br />� <br />Cunclusions constitute the basis of the decision of the Ever �tt Hearing <br />Examiner. <br />FINDINGS OF FACT <br />The Applicant requested approval of an exception to the Everett <br />Municipal Code, Sections 19.7.020.B and 19.7.020.H. These sections <br />limit the height of accessory buildings to 15 feet (Section 19.7.020.H), <br />and the combined square footage of afl detached accessory buildings to <br />1,000 square feet (Section 19.7.020.6). It is the intent of the Applicant to <br />construct a 936 square foot detached 20.5 foot high garage with an <br />attached 110 square foot shed and an 80 square foot covered entry. <br />The proposed project will occur at 816 - 35th Street, Everett, <br />Washington. (exhibit 1) <br />2. The subject property is zoned R-1, Single-Family Detached Low Density. <br />(exhibit 1) <br />3. EMC 19.7.020.K sets for±h the authority of the Hearing Examiner to allour <br />the cumulative area of acc:essory buildings to exceed 1,000 square feet, <br />and for a detached accessory building to exceed the 15 foot height <br />standard. The Hearing Examiner must determine if the proposal is <br />compatible with the dwelling and/or neighborhood character. Criteria to <br />be considered include view obstru�tions, aesthetic impact on <br />surrounding properties, and impacts on neighborhood character. <br />(exhibit 1) <br />4. The subject property was included in a Boundary Line Adjustment (BLA) <br />and resulted in an approximate 56,100 square foot lot. The proposed <br />garage will be located on the land added to the existing property as part <br />of the BLA. (exhibit 1, Ingalsbe testimony) <br />EMC 19.7.020.K(3) estabiishes that the maximum footprint of any <br />detached accessory building is either the square footage of the footprint <br />of the existing residence or 2,000 square feet, whichever is less. The <br />residence on the subject prop�rty has a footprint of 2,481 square feet <br />with a 702 square foot attachFd garage. The footpnnt of the propose� <br />detached accessory building would be 1,046 square feet.' (exhibit 1) <br />' EMC 19.7.020.K(3) is vague and confusing. This Ordinance does not provide c!arity as to <br />whether the 500 square feet of attached garage is to be included in the square footage of the <br />footprint of the dweiling, or, if it is to be excluded from the footprint of the dwelling, or, if �c is to <br />3 <br />
