however, indicated that if tne height of the building were set at 18 feet, <br />the pitch of the roof would be different than that if the building were 20.5 <br />feet in height. According to the architect for the .4pplicant, the difference <br />in pitch would not be an aesthetically pleasing result and would not <br />necessarily create compatibility with other structures in the <br />neighborhood. (George testimony) <br />13. An adjoining property owner testified to be in opposition to the request. <br />The property owner, whose property is listed for sale, su6mitted that the <br />proposed accessory building v�ill not be compatible and will not meet the <br />character of the neighborhood. (Greenblatt testimony) No corcoborating <br />testimony from other neighbors was submitted for this o�inion. <br />Jurfsdiction: The Hearing Examiner of the City of Ever�tt has jurisdictional <br />authority to hold a hearing and to issue the decision. That authority is set forth <br />in EMC 2.23.120. Based on the above Findings of Fact, the Hearing Examiner <br />enters the following Conr,lusions: <br />CONCLUSIONS <br />The Applicant requested approval of an exception to the Evarett <br />Municipal Code, Sections 19.7.020.6 and 19.7.020.H. These sections <br />limit the height of accessory buildings to 15 feet (Section 19.7.020.H), <br />and the combined square footage of all detached accessury buildings to <br />1,000 square feet (Section 19.7.020.6). It is the intent of the Applicant to <br />construct a 936 square foot detached 20.5 foot high garag2 with an <br />attached 110 square foot shed and an 80 sq��are foot covered entry. <br />The proposed project wili occur at 816 - 35th Street, Everett, <br />Washington. (frnding 1) <br />2. EMC 19.7.020.B estat�lishes that the combined total square footage of <br />all accessory buildings is to be the maximum of 15% of the tot�l lot area, <br />or 1,000 square feet, whichever is less. The 1,000 square foot standard <br />applies for this re quest. (finding 6) For relief from this standard, the <br />provisions of EMC 19.7.02Q.K must be satisfied. It must be shovrn that <br />there will be no view obstruction for the allowance of such a structure; <br />there will be no aesthetic impacts on surrounding properties and <br />streetscapes; the structure will not be incorr!oatible scale with dwellings <br />on surrounding properties; and, there will be no impaci on the <br />neighborhood chara;.ter. From the testimony and evidence submitted at <br />the public hearing, all of these criteria are satisfied by the proposal, and <br />the detached accessory building can be allowed. An exception to EMC <br />19.7.020.6 is granted. (�ndings 7 through 11) <br />
