This insLrumenc ��. ��r <br /> convenience, hereinafter referred to as "Declaration". <br /> RECITALS: <br /> A. Declarant is the owner of certain real property in <br /> the County of Snohomish, State of Washington. A leqal <br /> description of said real property is attached hereto as <br /> Exhibit "A" and by this reference incorporated herein <br /> (hereinafter "Total Parcel") . <br /> B. The Total Parcel is composed of two lots which are <br /> commercial building lots. <br /> C. Declarant desires to provide reciprocal easement <br /> for the usage of the Common Areas of Lots 1 and 2. "Common <br /> Area" as used in this Declaration means all areas not <br /> covered by the aforementioned buildinq or any expansion, <br /> reconfiguration or remodel thereof. These areas are to be <br /> used in common for access, circulation, utilities, <br /> landscaping and maintenance. <br /> As used in this Declaration, "Owner" means any party(s) <br /> having an ownership interest in Lots 1 and 2. "Tenant" <br /> means any tenants and subtenants granted a possessory <br /> interest in such Lots and their aqents, customers, business <br /> invitees, employees and occupants of the buildinqs on the <br /> Lots, subject to the provisions ar..d restrictions set forth <br /> below. <br /> NOW, THF:REFORE, Declarant hereby declares that Lots 1 <br /> and 2 shall be held and conveyed subject to this Declaration <br /> of the following terms: <br /> 1. Common Access, Circulation Easements. Each Owner <br /> and Tenant of Lots 1 and 2 shall have the non-exclusive <br /> riqht to use in common the access ways for inqress and <br /> egress, circulation and nedestrian traff.ic to and from the <br /> Lots.
