, 31Y August 10, 1988 RESOLUTION Resolution No. 3047 as amended is as follows: WHEREAS, application was made on Decembe[ 15, 1987, by Mueller Development Compar�y Eot a Sho[eline Substantial Development P?cmit; and WHEREAS, public heacin9s were held before the Hearing ' Examinec on Apcil 7, 1988, and Ap[il 11, 1988; and WHEREAS, the Heariny Examiner made findings, �onclusions, and a uec:sion which is hereby attached; and (on file in Clerk' s Office) WHEREAS, on June 7, 1988, the Silver Lake Action Committee filed an appeal, and on June 4, 1988, Ms. Do[otliy Vendeventer filed an appeal of the Hearing Examinec 's decision, which requires a pubJ.ic meeting befo�e City Council; and WHEREAS, on July 20, 1988 the City Council held a public meeting and determined that the Heacing Examiner may have made an ercoc in fact, law o� pcocedure and set a public hearing to fucthec disc;uss the pioject issues; and WHEREAS, the City Council finds, based on the Heacin9 ' ' Examiner's Findin9s, Conclusions and Decision, the tecotd of the Examiner 's Public Heacing and the record established at the City Council Public Hearin9 held on August 10, 1988 �hat thete was no error in pcoceduce, in fact or law in the tecord of this application; NOW, THEREFOAE, BE IT RESOLVED that the Everett City Council hereby Denies said appea2 and Grants the Shoceline Substantial Development Permit with the following revieions: Conditions #7, 8, 13, 15 and 19 of the Hearing Examinet 's repoct shall be amended to read as follows: 7 . A detailed landscaping plan showing size, type, and location of all plantings shall be ceviewed and appcoved by the Planning Department prioc to issuance of any permits. The plan will be designed to pcavide a quality develop�urnt compatibie with existing uses.
