, 31Y <br /> August 10, 1988 <br /> RESOLUTION <br /> Resolution No. 3047 as amended is as follows: <br /> WHEREAS, application was made on Decembe[ 15, 1987, by <br /> Mueller Development Compar�y Eot a Sho[eline Substantial Development <br /> P?cmit; and <br /> WHEREAS, public heacin9s were held before the Hearing <br />' Examinec on Apcil 7, 1988, and Ap[il 11, 1988; and <br /> WHEREAS, the Heariny Examiner made findings, �onclusions, and <br /> a uec:sion which is hereby attached; and (on file in Clerk' s Office) <br /> WHEREAS, on June 7, 1988, the Silver Lake Action Committee <br /> filed an appeal, and on June 4, 1988, Ms. Do[otliy Vendeventer filed <br /> an appeal of the Hearing Examinec 's decision, which requires a <br /> pubJ.ic meeting befo�e City Council; and <br /> WHEREAS, on July 20, 1988 the City Council held a public <br /> meeting and determined that the Heacing Examiner may have made an <br /> ercoc in fact, law o� pcocedure and set a public hearing to fucthec <br /> disc;uss the pioject issues; and <br /> WHEREAS, the City Council finds, based on the Heacin9 <br /> ' ' Examiner's Findin9s, Conclusions and Decision, the tecotd of the <br /> Examiner 's Public Heacing and the record established at the City <br /> Council Public Hearin9 held on August 10, 1988 �hat thete was no <br /> error in pcoceduce, in fact or law in the tecord of this application; <br /> NOW, THEREFOAE, BE IT RESOLVED that the Everett City Council <br /> hereby Denies said appea2 and Grants the Shoceline Substantial <br /> Development Permit with the following revieions: <br /> Conditions #7, 8, 13, 15 and 19 of the Hearing Examinet 's repoct <br /> shall be amended to read as follows: <br /> 7 . A detailed landscaping plan showing size, type, and <br /> location of all plantings shall be ceviewed and <br /> appcoved by the Planning Department prioc to issuance <br /> of any permits. The plan will be designed to pcavide a <br /> quality develop�urnt compatibie with existing uses. <br /> This plan must show at a minimum a) an inventory be <br /> completed by the deveLoper of evecgreens presently on <br /> subject prope[ty and no vegetation will be �emoved <br /> until final site plan is appioved.
