QCN) NOW, THEREFFORE, Declarant hereby covenants and agrees as follows: 1. The storm drainage system shall be continually maintained at Declarant's sole cost and expense, in accordance with and in the manner specified by the applicable regulations and standards of the City for maintenance of private storm drainage systems. At the minimum, maintenance of the storm drainage system shall include the following routine maintenance: (a) Cleaning and/or repair of the oil/water separator system on a o_uarterly basis, or more often if needed; and, (b) Cleaning of the arass line swails once every six (6) months. Replant grasslined swales with appropriate plantings as necessary to maintain the functional water quality purification benefits of the system as designed. 2. The .vetland area and buffer zone shall be preserved, fenced and maintained in accordance ,7ith and in the manner specified by applicable regulations and standards of the State Department of Ecology (DOE), and the City for maintenance and preservation of wetlands. 3. In the event the City determines Declarant has failed to maintain the storm drainace system and/or wetland areas as set forth herein, the City shall give written notice to the Declarant specifying the maintenance found by the City to be needed.
