Provided, however, Declarant <br />shall not be responsible .for and shall have no obligation to <br />reimburse the City for any extra repairs or maintenance of the <br />storm drainage system and/or wetland areas which may be <br />necessitated solely by actions, omissions or negligence of the <br />City of Everett or third party activities occurring off the <br />subject property. <br />4. All tenant leases or rental agreements for the project <br />and condominium documents, if any, shall provide that vehicle <br />maintenance is not allowed on the property, and washing of <br />vehicles is only allowed in a specific area set aside for that <br />purpose, if any. A violation of the lease or rental agreement <br />restrictions set forth in this paragraph shall constitute a <br />breach of the lease. <br />5. Declarant shall not attempt, directly or indirectly, to <br />have a vehicular access to and/or from 23rd Drive and connecting <br />with the project; provided, however, if, in the future, the City <br />or other regulatory agency with jurisdiction requires traffic <br />from the Project to utilize 23rd Drive, such useage shall not be <br />deemed to violate this covenant. <br />6.
