j <br /> 10. The commercial activity µ�ill include retail shops. The design of the <br /> structures and the parking layout are conducive for this type of <br /> commercial activity. (Ervine testimony) <br /> 11. Parking has been desiyned and will be landscaped to minimize adverse <br /> impacts on the adjacent shoreline of Silver Lake and any abutting <br /> properties. The landscaping, as called out in the information in the <br /> SEPA review, will address the aesthetics of the site. (Ervine testimony, <br /> Brent testimony) <br /> 12. In order to develop the site, a rezone of a portion of the site is required. i <br /> The area proposed for Phase I development is currently zoned B-1, <br /> Neighborhood Business and can be developed as proposed. Phase II <br /> development (Building D) can proceed only if a Comprehensive Plan <br /> change and Resolution of Intent to Rezone from R-1, Single-Family Low <br /> Density to B-1 is approved by the Planning Commission and City <br /> Council of the City of Everett. The Planning Commission has <br /> recommended approval of this requested rezone. (Staff report) <br /> 13. As part of the development, the City identified impacts to tra�c flow on <br /> 19th Avenue S.E. To mitigate these impacts, the City recommended <br /> standard (haif) street improvements to 19th Avenue S.E. on the subject <br /> property's frontage. The improvements wili include, but not be limited to, <br /> curb, gutter, sidewalk, street widening, and drainage control pursuant to <br /> the City Design Standards. If the Applicant opts to make a payment in <br /> lieu of these improvements, the City determined that he shall pay $200 a <br /> front foot to the City for the improvements of 19th Avenue S.E. The <br /> Applicant agreed that impacts to 19th Avenue S.E. exist and that the <br /> mitigation measures are reasonable and accurate. (Exhibit 4, Ervine <br /> testimony, Brent testimony) <br /> 14. If necessary, right-of-way must be dedicated to the City for street <br /> improvements for 19th Avenue S.E. The right-of-way that would be <br /> dedicated would be from the subject property's frontage. (Ervine <br /> testimony) <br /> 15. The subject property is within the Silver Lake Drainage Basin. There is <br /> a wetpond with a vegetated swale that provides stormwater treatment for <br /> paved runoff from other newly paved surfaces. However, there is a <br /> portion of the subject property that is currently developed but has no <br /> 4 <br /> �Z <br />
