Even if that were not the case, our customers' privacy <br /> while tanning can hardly be assured while the doors to the tanning room remain <br /> unlocked to allow access at any and all times to the deck and stairs. Prcdictably, this <br /> will raduce my clienYs tanning bed income by 25%, which he, like most small business <br /> owners, cannot afford. That is a totally unacceptable solution, especially when there <br /> are alternatives that are aimost c�st free, far less burdensome and almost without cost <br /> and certainly feasible. <br /> My client and Enrapture have been at odds for some time over many issues, including <br /> Enrapture's elimination of my clienYs prior access to the existing fire escape on the west <br /> side of the building. That dispute is how the City of Everett became involved with this <br /> building in the first place. Now, it seems that the very person who is seeking the City tc <br /> provide him no less and no more than the protection that he had previously (and to <br /> which he is entitled) is being asked to carry virtually all of burden of the purported <br /> "solution". I submit that the "solution" �ubmitted by Enrapture in its plans is actually <br /> thinly veiled retribution for my clienYs persistence in the pursuit of his legitimate claims <br /> against them. li would be unbecoming for the City of Everett to be a part of it, though I <br /> am sure that until new, the City was unaware of the room configurations and the <br /> practical problems posed by the Enrapture proposai. <br /> A very feasible alternative that would be fa� less expensive, more efficient and �vithout <br /> placing a financial burden on my client (or on Enrapture) would be to convert th., <br /> existing locked common doorway between Tropitana and Cnrapture into an unlocked <br /> access poi it between the two suites, so that Tropitana and its customers would have <br /> access to the deck and the stairway. If this very feasible idea is adopted, there would <br /> be no need to extend the deck, build a doorway or eliminate one of my clienYs tanning <br /> rooms. <br /> It would be appealing to say: how can we force Enrapture to adopt this solution and give <br /> up its dominion over its leased space. However, wauldn't that be the case for Tropitana <br /> if the current proposal is adopted? <br /> I have enclosed photographs of the exterior deck and stairway as it exists today, as well <br /> as a photograph of the interior of my client's space showing where the proposed <br /> doorway would be cut through the exterior so as to virtually eliminate one tanning room. <br /> Another picture shows the common doorway between Suites 4 and 5.
