Tidball
Community Prosecutor
City of Everett
2930 Wetmore Avenue
Everett, WA 98201
Re: Wright Building.
My client: James Desmul d.b.a. "Tropitana".
Dear Ms. Tidball;
I represent James Desmul, the owner of Trepitana, located at Suite 5 of the Wright
Building, 11525 19h Avenue SE, in Everett, b'Jashington. My client is the subtenant of
Enrapture, inc., who is leasing the entire floor from the building owner, Michaei Wright.
I am sorry that I was not able to attend the joint meeting last week at your office wherein
the necessary code compliance issues discussed among the various parties as
well as the attorneys for the Enrapture o..,ers and Mr. Wright. I was pleased to hear
that the ity was taking action to move this situation along to a resolution. We are in
agreement as to the resolutions reached, except one that we consider very significant
and unnecessarily detrimental to my client.
What is categorically and unequivocally unsatisfactory to my client is the proposal
offered for the resolution of the fire exit probiem. I have seen a copy of Enrapture's
proposed plans and note that they call for the northward extension of the deck, along
the western side of the building in order to allow my client and his customers an
emergency exit from the building and access to the existing stairway. I also understand
that an exterior door is to be located and built in my clienYs space, specifically in one of
my clienYs small tanning rooms.
We must protest this as it cnates a most serious and unworkable situation for my client
in that it will make one of his four tanning rooms totally unusable. I believe that even if it
were Ieft in the smail closet-sized room, the tanning bed would totally obstruct any
C9Documents and Seltings\Itidball\Local Settincs\Temporary Intemet Files10LK2C\lidball.doc 10/10I06(I)#25337.001 1 y
