Declarant further covenants and agrees to <br /> 1 <br /> continually maintain and preserve the Vegetative Plantings <br /> within the Yreserved Storm Drainage system at Declarant ' s <br /> Sole cost and expense, in accorance with and in the <br /> manner specified by applicable regulations and standards of <br /> the State Department of Ecology (DOE) and the City for <br /> maintenance and preservation of Vegatative Plantings of <br /> created wet ponds and swale systems . . <br /> 3. Declarant further agrees to condition maintenance <br /> contracts, if applicable, so that contractors or maintnenace <br /> employees are prohibited from disposing of parking lot surface <br /> debri and/or contaminated collected water to the Storm <br /> Drainage System. <br /> 4 . In the event the City determines Declarant has <br /> failed to maintain the Storm Drainage System and/or <br /> wet pond, swales and Vegetative Plantings as set forth <br /> her•ein, the City shall give written notice to Declarant <br />' specifying the maintenance found by the City to be needed. <br /> If , after thirty (30) days of receipt ot said notice from <br /> the City, Declarant has failed to comaly with the <br /> specified mainenance , the City shall have the right to <br /> enter upon the Property and to cure such failure by <br /> performing the specified maintenance , and Declarant shall <br /> be responsible for and shall promptly reimburse the �ity <br /> - � - <br />
