7. The issues related to the comprehensive plan and zoning designations <br />that were placed on the site were discussed at length in public <br />hearings before City Council prior to the annexation and then in <br />conjunction with the comprehensive plan and zoning decisions. Before <br />the Planning Commission and City Council there were five public <br />hearings regarding the annexation, four public hearings regarding the <br />comprehensive plan designations, and three public hearings regarding <br />the zoning decision. <br />8. After those broader comprehensive planning and zoning decisions have <br />been made and when a specific proposal is submitted to the City for <br />review, the City then reviews the project on a more site specific <br />basis. The staff determines whether the proposal is consistent with <br />the Comprehensive Plan and Zoning designations ou the property. Staff <br />also determines the specific environmental impacts of the proposal and <br />how those impacts can be reasonably mitigated. The mitigation <br />requirements must be based on the policies in the City's SEPA <br />Ordinance, as adopted by City Council. <br />9. In reaching its decision, the City Council considered the discussion <br />and testimony presented at the hearing, slides presented at the <br />hearing, exhibits presented at the hearing, and the documents and <br />exhibits forwarded to the City Council by the Planning Department, <br />including the Silver Lake Action Committee appeal. <br />10. On October 28, 1987, the City of Everett City Council voted to revise <br />the Mitigated Determination of Non -Significance issued by the Planning <br />Director through the exercise of substantive authority under SEPA, and <br />added a number of mitigation requirements to the DNS. <br />FINDINGS <br />1. On June 10, 1987, the City received an application from Mike Brown, <br />Metco Construction, Inc. for a SEPA environmental review to construct a <br />178 unit apartment complex on an approximately 9.5 acre site. The <br />property is zoned R -3(A) which permits multiple family uses (243 units <br />would be permitted on the site). <br />2. After review of an Environmental Checklist and public comments for the <br />above proposal, a Final Mitigated Determination of Non -Significance <br />(DNS) was issued on September 16, 1987. On September 24, 1987, an <br />appeal of the DNS was submitted by Pamela Lux, Secretary, Silver Lake <br />Action Committee, 2225 - 116th Street S. E., Everett, WA 98208. The <br />issues appealed include drainage, animals, noise, light and glare, <br />traffic and air emissions, public services impacts, and a requirement <br />for the developer to sign a L.I.D. covenant for street improvements to <br />19th Ave. S.E. <br />
