APPEAL OF PLANNING DIRECTOR'S DECISION UNDER SEPA <br />METCO CONSTRUCTION APARTMENTS (SEPA #74-87) <br />FINDINGS, CONCLUSIONS, AND DECISION <br />INTRODUCTION <br />1, On June 10, 1987, the City received an application from Mike Brown, <br />Metco Construction, Inc. for a SEPA environmental review to construct a <br />178 unit apartment complex on an approximately 9.5 acre site. The <br />propertyis zoned R -3(A) which permits multiple family uses (243 units <br />would be permitted on the site). <br />2. After review of an Environmental Checklist and public comments on the <br />above proposal, a Final Mitigated Determination of Non -Significance <br />(DNS) was issued on September 16, 1987. <br />3. On September 24 1987, an appeal of the DNS was submitted by Pamela Lux, <br />Secretary, Silver Lake Action Committee, 2225 - 116th Street S.E., <br />Everett, WA 98208. The issues appealed include drainage, animals, <br />noise, light and glare, traffic and air emissions, public services <br />impacts, and a requirement for the developer to sign a L.I.D. covenant <br />for street improvements to 19th Ave. S.E. <br />4. City Council is responsible for hearing appeals of SEPA decisions when <br />a proposal is conditioned or denied on the basis of SEPA by a <br />non -elected official. <br />5. A public hearing was held before City Council on October 28, 1987, to <br />hear the appeal of the Mitigated Determination of Non -Significance. <br />Testifying on behalf of the City were Bob Landles, Environmental <br />Coordinator; Mary Cunningham, Associate Planner; Larry Crawford, Public <br />Services Manager; Dave Davis, Traffic Engineer; and Jim Iles, Assistant <br />City Attorney. Testifying on behalf of the applicant were Mike Brown, <br />Metco Construction Property Manager; Jim Miller, Lovell-Sauerland and <br />Associates; Robert Jones, P.E., Lovell-Sauerland and Associates; and <br />Dick Mietzner, Metco Construction. Testifying on behalf of the <br />appellant were Mr. Don Britton, a Snohomish County Councilman; Pamela <br />Lux, 2225 116th St. S.E.; Jack Dinneen, 2108 122nd Place S.E.; Tom Lux, <br />2225 116th S.E.; Larry Comp, 2033 122nd Fl.; Paul Miller, 12004 25th <br />Ave. S.E..; Neal Jeans, 12709 16th Ave. S.E.; Harold Jones, 12029 Ruggs <br />Loop Rd.; Duane Osterud, 2010 122nd S.E.; Velma Hoffman, 2026 122nd P1. <br />S.E.; and Virgil Scott, 11901 25th Ave. S.E. <br />6. The area was annexed into the City in 1984. The Comprehensive Plan <br />designation for the site is Multiple Family (15 to 25 dwelling units <br />per gross acre). The zoning designation for the site is R -3(A), <br />Multiple Family Residential Site Plan Review Zone. The annexation was <br />motivated by the need for sewer services in the area, where there were <br />a large concentration of failing septic systems. Part of the reason <br />that the R -3(A) density was provided on the property was to allow the <br />property owners to fund the substantial costs associated with the sewer <br />L.I.D. <br />
