DECISION <br />The Mitigated Determination of Non -Significance (174-87 for Metco Construction <br />apartments issued by the Planning Director on September 16, 1987, is upheld <br />and shall be revised as follows: <br />Condition 3 on page 2 of the Determination is revised to read, <br />"Prior to the issuance of any permits, a detailed drainage plan must be <br />reviewed and approved by the City. On-site detention must be provided <br />for all storm events. To the extent feasible, the developer should <br />maximize detention in the wetland areas to provide more efficient <br />detention in one and two year storms and tweuty-five and fifty year <br />storms. Drainage must be routed so that it does not run off onto <br />adjacent properties. If possible, drainage should be handled in open <br />swales." <br />The following conditions are added to the Mitigated Determination of <br />Non -Significance: <br />24. The final site plan be consistent with the site plan displayed and <br />described to Council at this hearing, which includes 25 foot setbacks <br />on the north and south boundary lines and a 15 foot setback on the east <br />boundary line. <br />Fencing, berming and dense evergreen buffer around the North, South and <br />East boundary of the site, except in those areas where the preservation <br />of existing tree cover and wetland protection dictates that such a <br />buffer not be provided and those areas where it is not provided will be <br />at the determination of the City staff. Otherwise it will be provided <br />along the entire north, south and east boundary. <br />26. Save as much of the natural vegetation as possible on the site, <br />especially respecting the evergreen tree cover and will defer to staff <br />to which of those vegetation areas need to be preserved. <br />27. Provide wetland enhancement to diversify and increase the habitat value <br />as allowed by the resource agencies with jurisdiction over such wetland <br />areas. <br />25. <br />28. Provide and record a covenant on the property guaranteeing maintenance <br />of oil and water separators with provisions for the right of City <br />enforcement of those binding on the owner, Metco, and all future heirs, <br />successors and assigns. <br />29. Proceed with frontage improvements along the frontage of 19th Avenue <br />S.E. as identified in the staff recommendatior without the benefit of <br />an L.I.D. <br />30. Record a L.I.D. or R.I.D. non -protest agreement binding Metco and all <br />future owners, successors and assigns to not protest the formation of <br />any local improvement district for the improvements to 19th Avenue S.E. <br />as net forth in the staff recommendation. <br />-14- <br />
