16 <br />RESOLUTION NO. <br />RESOLUTION OF INTENT TO REZONE <br />"GREENSPACE, INC. PROPERTY," 9707 &9709 19TH AVENUE SE <br />FROM R-2(A) TO B-2 <br />WHEREAS, Greenspace, Inc., filed an application to rezone property located at 9707 and <br />9709 19th Avenue SE from R-2(A) (Single Family Attached Medium Density) to B-2 <br />(Community Business) for the purpose of establishing a mixed use office and retail <br />development, the legal description for which is: <br />That portion of the west 289 feet of the North half of the South half of the North half of <br />the Southwest quarter of the Southwest quarter of Section 17, Township 28 North, <br />Range 5 East, Willamette Meridian, lying east of the right-of-way of 19th Avenue SE; <br />together with the west 50 feet of Lot 1, Saundar Estates, as per plat recorded in Volume <br />39 of Plats, Page 181, Records of Snohomish County. Situate in Section 17, T. 28 N., <br />R. 5 E., Willamette Meridian, in the County of Snohomish, State of Washington. <br />and <br />WHEREAS, the B-2 zone allows uses which could have a detrimental ;mpact on the single <br />family residential zone abutting the subject p-operty to the north, east and south; and <br />WHEREAS, the Planning Commission, after holding a public hearing, did adopt certain <br />Findings and recommended to the City Council that the proposed rezone be approved <br />pursuant to the provisions of Section 41.160.D.7 of Ordinance No. 1671-89, as amended, and <br />subject to the specific conditions set forth in said recommendation; and <br />WHEREAS, the City of Everett, hereinafter referred to as "City," finds that by limiting the <br />permitted uses of the subject property and by establishing certain standards for the <br />development of the property to be rezoned, that the residentia: property abutting to the north, <br />east and south of the subject property cart be adequately protected from the impacts of <br />commercial use of the property to be rezoned; and <br />WHEREAS, the Everett Zoning Code provides a mechanism by which the City and property <br />owner may enter into a "performance agreement" wherein the proponent of a rezone agrees to <br />develop property according to the terms of the agreement before the rezone is finalized by the <br />City; and <br />WHEREAS, the City Council finds: <br />1.
