Crawford <br />Engineering/Publiz Services Director <br />City of Everett <br />3200 Cedar Street <br />Everett, Washington 98201 <br />RE: HomeBase #142 - Everett, Washington <br />Dear Lam: <br />llU ic6F E�ERETT <br />Works Dept. <br />VIA U.S. MAIL <br />& FACSIMILE <br />(425n57-8829) <br />As you arc aware, Michaehs-Swenson Partners, the Owner and Developer of the HomeBase, Everett, <br />Washington project is required by the City of Everett to execute a Hold Harmless Agreement with the <br />City of Everett relating to the site grading, filling and construction of the storm water detention <br />facilities required for the HomeBase project. <br />As discussed with you today and to confirm our understanding with you, HomeBase, Inc. is not a party <br />to the Hold Harmless Agreement and has no liability with the design and construction of the filling of <br />the on site wetland and the design and construction of the storm water system as well as any <br />downstream disturbances and damage associated herewith. <br />The only obligation HomeBase has relating to this project is the maintenance of the on site and off site <br />storm detention facilities and off site wetland mitigation area as to the extent set forth in our Lease with <br />Michaelis -Swenson Partners, when HomeBase opens for business. <br />Please be advised that Michaelis -Swenson Partners is not authorized to take any actions or reach any <br />agreements that are binding on HomeBase, Inc. and Michaelis -Swenson Partners is not in any way an <br />agent or representative and have no authority to act on HomeBase, Inc.'s behalf. <br />If this is consistent with your understanding, please counter -sign this letter (faxed version) and return a <br />copy to my office 6a facsimile (714/442-5120) and a hard copy pia U.S. Mail. <br />Sincerely, , <br />i <br />;(�,Q. <br />Steph n L.
