r
T0: Jim Iles, Assistant City Attorney,
 FROM: Marian Dent, Housing Inspectorl-'
DATE: July 19, 1982
SUJECT: Corner property with 74" fence at
19th and Rainer - 1832 Rainier
On May 6, 1982, permit No. 10528 was issued to Daniel Lilley for
constructing a 72" fence in rear property of 1832 Rainier.
On May 10, 1982,after receiving a complaint from the neighbor to
the north of 1832 Rainier, I inspected the fence and foun that a
72" fence had been constructed between 1832 Rainier and 1826 Rainier,
from the alley to the sidewalk on Rainier.
On May 11, after considerable deliberation between the Building
Department Staff and Dennis Gregoire of the Planning Department,
a determination was arrived at and Dennis wrote a memo stating,
"The house at 1832 Rainier can have a{2" fence from their north-
east corner to the Rainier Right-of-Way. Since the address is
Rainier, the front yard is on Rainier."
On May 17, 1982, Larr} Callahan sent a letter to Mr. L411ey indicating
the zoning violations with the fence and correct height requirements
to meet compliance with the code.
7here was no response from Mr. Lilley and the fence remained 72"
in height. On May 26th I lePt a message on the door of 1832 Rainier
to have Mr. Lilley call,
Apparently, while this was happening, Mr, and Mrs. Lilley applied
for an address change from 1832 Rainier to 2211 - 19th Street,
changing the entire perspective of their front and back yards.
Mrs. Lilley called on May 27th and, after some discussi,on, she
indicated that the fence would be lowered to 42" as the Department
required.
An inspection on June 2, 1982 revealed the fence to be 42" and in
compliance. The upper portion of the fence was lying on the ground.
Today I received another call from Mrs. Foster, who lives at 1R26 Rainier.
The fence was up again. I took some measurements and pictures this
time. Attached is a copy of the file. In it is a copy of a letter
dated May 19, 1982 from our Public Works Department changing the
address of 1832 Rainier to 2211 - 19th,
L
