As you are aware the City Code, EMC 19.42, permits fences with a <br />height of forty-two inches on any property line and fences with a height of <br />seventy-two inches only in the rear or side yards. The critical question which must <br />be answered is in what ynrd has the seventy-two inch fence been constructed. <br />EMC 19.04.010(37) defines "front yard" as follows: <br />". .. an open space extending across the full width of the lot, the <br />required depth of which shall be measured hocizontally from the front <br />line to a line parallel thereto on the lot:' <br />Since the "width" of your lot is the distance between your northern and southern <br />boundary lines, then your "front yard" is the yard facing Rainier, not 19th Street. <br />The fact that you changed your street address doesn'2 change your yerd <br />designation. The fence code which is part of the zoning code does not corre]ate <br />the front yard designation with the street address. By changing your street address <br />you can't change your front yard designation. While often times a street address is <br />indicative of the front yard designation, it is not controlling. <br />Therefore,I am asking that you reduce the height of your fence on yo� northern <br />property line to forty-two inches. The forty-two inch restriction applies to the <br />fence in your front yard whieh is the area extending easterly trom the most <br />easterly portion of your home to the Rninier right-of-way.
