1. Agreement. For and in consideradon of the mutual benefits and conditions contained in this Agreement, the City and the O�vner agree as follows: 2. Recitals. p. The Owner is the owner of certain real nroperty located in Snohomish County, Washington ("Property"), within the Urban Growth Area of the City, legally described as set forth in Exhibit A attached hereto and incorporated herein by this reference. B. The Property is not currently within the city limits of the City ("City Limits"). C, The Owner desires to connect the Property to the City's water and/or sewer utility system ("City System"). 3. Title. The Owner warrants that the Owner is the owner of the Property and is authorized to enter into this Agreement. 4. Extension Authorized — City's Ordinances Regulations and Policies. The City hereby authorizes the Owner to extend service to the Property. Tkte Owner hereby agrees to comply with, be bound by and be subject to the City's ordinances, regulations and policies conceming such service. 5. Construction. Promptly after execution of this Agreement, the Owner shall submit to the City a schedule for design and construction of the exteasion to the Property and any City-required capital facilities associated therewith, including without limitation water and sewer main lines and pump stations (collectively, "Extension"). When the Owner makes changes in the schedule, the Owner shall suUmit updates of the schedule to the City. The City's Public Utilities Director shall review and approve in writing the plans, specifications and drawings of the Extension before constructi�n commences. All construction of the Extension shall be completed in accordance with City standards now existing or as hereafter amended. The Owner shall permit the City to inspect the construction and installatian of the Extension at any time before connection is made to the Ciry System. The City may reject any construction and installation not conforming to the approved design of the Extension and the requiremenu of this Agreement. 6. Permiu, Easements and Licenses. The Owner shall secure and obtain at the Owner's sole cost and expense any necessary permits, easements and licenses to construct the Extension, including without limitation all necessary easemenu, excavation permits, street use ��o,�„ o� -1- i9y�� 2o3oIs4
