permits or other permits required by state, county and City goveramental departanents, including <br />withoat limitation the State Deparhnent of Ecology, Snohomish County Public VJorks <br />Department, Snohomish County Planning and Development Services Departrnent, Snohomish <br />County Boundary Review Board and the City's Public Work's Department. <br />7. Costs. The Owner shall pay all costs of designing, engineering and constructing <br />the �xtension and all costs incurred by the Ciry in reviewin6 plans for and inspecting <br />construction of the Extension. The Owner shall beaz the risk of loss for or damage to all finished <br />or partially finished work on the Extension until the Extension is accepted by the City. <br />8. Connecdon Chazges. The Owner agrees to pay: (a) connection chazges for water <br />and for sewer at the rate schedules applicable at the time the Owner connects the Property to the <br />City System; and (b) any field wsts of the City, which shall be chazged at time and materials <br />plus ] 5% overhead. <br />9. Service Chazges. In addition to the coanection chazges, the Owner agrees to pay <br />for utility service rendered by the City in accordance with. rates chazged that aze uniform for the <br />class of customer or service supplied, as such rates exist or as they may be hereafter amended or <br />modified, together with any utiliry taxes levied from time to time. The Owner acknowledges that <br />service charges may consist of base chazges as well as chazges determined in accordance with <br />the level of service provided. <br />10. Annexation. This Agreement constitutes an irtevocable notice to the City of <br />intention to commence annexation procedures. The Owner waives all applicable time <br />requirements that require the City Council to meet within a prescribed time sifter receipt of this <br />notice to decide �vhether the City will accept the Property for s,tu►exation. The Owner <br />acknowledges that the consequences of annexation of the Property to the City will include but <br />not be limited to: <br />SOOT9ri10) <br />A. Snohomish County ordinances, resolutions, niles and regulations <br />applicable to unincorporated azeas will generally cease to apply to the <br />Property upon the affective date of annexation; <br />B. City ordinances, resolutions, rules and regulations will begin to apply to <br />�he Property upon the effectivr, date of annexation; <br />C. Govemmental services, such as police and fire, may be provided and/or <br />made available to the Property by the City upon the effective date of <br />annexation; <br />D. The Property may be required to assume a portion of the existing City <br />indebtedness, and properry tax rates and asse;smenu applicable to the <br />-2- <br />199��2030Y84 <br />
