Property may be different from those applicable prior to the effective date <br />ofannexation; <br />E. The Property may be subject to and a part of the City's Comprehensive <br />Plan, which may differ from that in effect prior to We effective date of <br />anneiation; <br />F. ?cning and land use regulations applicable to the Property after <br />annexation may be different from those applicable to the Property prior to <br />annexation; and <br />G. All dr any portion of the Property may be annexed and the Property may <br />be azuaexed in conjunction with, or at the same time as, other property in <br />the vicitity. <br />With full knowledge and und:rstanding of the consequences of annexation and with full <br />knowledge and understanding of the Owner's decision to forego opposition to annexation of the <br />Property to the City, the Owner agrees to sign a petition for annexation to the City of the <br />Property as provided in RCW 35.1?.130, as it now exists or may hereafter be amended, at such <br />time as the Owner is requested by the City to do so. The Uwner also agrees and appoints the <br />Mayor of the City as the Owner's attomey-in-fact to execute an annexation petition on the <br />Owner's behalf in the event that the Owner shall fail or refuse to do so and agrees that such <br />signature shall constitute full authorit,y irom the Owner for annexation as if the Owner had <br />signed the petition. If the Owner is a corporation, this Agreement shall be executed by an officer <br />authorized to execute deeds or encumbraaces on Uehalf of the Owner, and there shall be attached <br />to this Agreement as Exhibit B a certified excerpt from the bylaws of the Owner showing such <br />authority. <br />With full knowledge and understanding of the Owner's right to: <br />A. Notice of a public hearing on the annexation of the Property to the City; <br />and <br />B. Appeaz at such public hearing and voice disapproval of the anne:cation; <br />The Owner waives these righu and further agtees not to lidgate, challenge or in any manner <br />contest, annexation to the City. This Agreement shall be deemed to be continu:ng, and if the <br />Owner's property is not annexed for whatever reason, including a decision by the City not to <br />annex, the Owner agrees to sign any and all subsequent petitions for annexadons and agrees not <br />to litigate, challenge or in any manner contest any such subsequent annexation to the City. In the � <br />event that any or all of tbe Yroperty is subdivided into smaller lots, the Uwner shall cause the <br />purchasers of each subdivided lot to be bound by the provisions of this Section. <br />500799t10] <br />�� <br />19��X 2Q30I84 <br />
