(Section 19.40.020) <br />The application, ae submitted, for a ilse Permit (under Chapter 19.64 of the <br />Zoning Code) for 2102 Hoyt is hereby denied. The Use Permit cannot be <br />granted until the Zoning Code violations which have been identified on this <br />propertq and ithich are summarized above have been currected and because the <br />use has been establiehed and occupied in violation of Section 19.64.020(C). <br />However, a Uee Permit application which meeta the following conditiona Will <br />be approved, if submitted: <br />1. Submit complete applications and obtain Building permits and <br />inepectione on or before June 23, 1989, for any conetruction <br />coopleted withiii the last 24 mon[he or for any propose3 construction. <br />2. The new occupancy for 2102-4 }ioyt is classified as R-3 by rhe Uniform <br />Building Code (UBC). The occupancy must comply with Chapter 12 <br />zequirements of the UBC. This may include, hut le not limited to, <br />providing emergency egress, at least one water closet with separate <br />facilit�ea when both aexes are accommodated, smoke detectora for each <br />room, and one-hour construction separating the common laundry room, <br />storage space, and the furnace room. <br />3. All Fire Code requirements must be complied with and approval from <br />the City's Fire Marshal is required by Auguat 15, 1989, or the <br />occupancy must be returned to a single family reaidence. <br />4. The City righ[-of-way cannot be ❑sed for providing any portion of the <br />required parking. The required 5 parking spaces muet be paved and <br />provided on the building site per Public Works standards. A <br />permanent non-exclucive parking and access easement agreement between <br />the separate residentlal properties of 2102-4 floyt and 2108 lioyt muat <br />be aubmitted to and approved by the City by June 23, 1989. Parking <br />must be permanently available as long as the rooming house use is in <br />exiatence. The easement must be recorded ae a covenant which muet <br />run with the titles for 2102-4 and 2108 Hoyt. <br />
