July 28, 1976 227 <br />the work required and specified in said notice pursuant to and in accordance <br />with said City of Everett Building Code on the grounds of the failure, <br />neglect or refusal of said owner(s) to comply with the provisions of said <br />notice, and whereas the Everett City Council after examining exhibits and <br />hearing testimony and arguments and being otherwise fully informed in the <br />premises makes the following findings: <br />1. That said City of Everett Building Code is a valid existing ordinance <br />of the City of Everett. <br />2. That the hereinabove described NOTICE OF UNSAFE BUILDINGS) was <br />properly issued and served pursuant to and in accordance with the <br />hereinabove described City of Everett Building Code. <br />3. That the City of Everett Building Official is authorized to request <br />the Everett City Council to enter the hereinabove described order <br />and that the Everett City Council is authorized in the exercise of its <br />discretion to so do under the provisions of said City of Everett <br />Building Code. <br />4. That those named in said r,atice as the owner(s) of said unsafe building(s), <br />structure(s), or portion (s) thereof were heretofore timely notified <br />that the hereinabove described request of the City of Everett Building <br />Official would be presented to the Everett City Council in regular <br />public meeting on the hereinabove mentioned date and that said owner(s) <br />were further heretofore timely notified that the owner(s) or duly <br />authorized representative(s) shall have the right to appear before and <br />present such evidence and/or arguments to the Everett City Council <br />relating to the herein described matter as may be desired in said <br />regular public meeting on said date. <br />5. That the building(s), structure(s), or portion (s) thereof described <br />in said notice are unsafe and a public nuisance under the provisions <br />of said City of Everett Building Code in the respects set forth in said <br />notice. <br />6. That those named in said notice as the owner(s) of said unsafe building(s), <br />structure(s), or portion(s) thereof have failed, neglected or refused <br />to comply with the provisions of said City of Everett Building Code. <br />Whereas the Everett City Council upon due consideration deem it desirable <br />in the best interests of the public health, safety, property and welfare <br />that said requested order shall enter. <br />Now, therefore, be it resolved by the City Council. of the City of Everett <br />as follows: <br />Section 1. The City Attorney of the City of Everett be and hereby is <br />authorized to initiate criminal prosecution against each of those named <br />in the hereinabove described NOTICE OF UNSAFE BUILDING(S) as the owner(s) <br />of the unsafe building(s), structure(s), or portion(s) thereof described <br />in said notice as a violator of the provisions of the City of Everett <br />Building Code, Chapter 16.04 Everett City Code .adopting and amending the <br />Uniform Building Code 1973 Edition prepared by the International Conference <br />of Building Officials. <br />Section 2. The City of Everett Building Official be and hereby is auth- <br />o:-iz— ed and directed to proceed with the work required and specified in the <br />hereinabove described NOTICE OF UNSAFE BUILDINGS) in accordance with <br />the provisions of the hereinabove described City of Everett Building Code; <br />provided, however, said work shall not be commenced until not less than <br />10 days after date of personal service or 15 days after date of mailing <br />by registered mail or certified mail of notice of the herein described <br />Everett City Council order (resolution) to each of those named in said <br />NOTICE OF UNSAFE BUILDINGS) as the owner(s) of the unsafe building(s) <br />structure(s), or portion(s) thereof described in said NOTICE OF UNSAFE <br />BUILDINGS) as the owner(s) of the unsafe building(s), structure(s), or <br />portion(s) thereof described in said NOTICE OF UNSAFE•, BUILDING(S). <br />Roll was called with all councilmen voting yes except Councilmen Langus <br />and Moore who were excused. <br />Motion Carried <br />BID CALL (767-233) <br />Moved by Councilman Aldcroft, seconded by Councilman Michelson, to approve <br />plans and specifications and call for bids for Norton Avenue Improvement, <br />Phase IV, L-nes 3 and 4. Bids to be received until August 5th, 1976. <br />
