BOARD OF ADJUSTMENT <br />EINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE #13-95 <br />Based upen the written request for a variance from the City's Zoning Code by: <br />Applicant: <br />Location: <br />Zoning: <br />Shaun & Tonja Burke <br />2130 Pine Street <br />Everett, WA 98201 <br />2130 Pine Street (comer of alley and 22nd Street ) <br />R-2, Single Family Residential <br />hereinafter referred to as "applicant," for a variamce from Section 9 of the City's Use Standards <br />Table which requires a minimum setback of 20 feet for structures containing living space from <br />the front and rear property lines. ►'he appiicant is proposing to construc:t a new smgle family <br />residence on x non conforming lot. <br />Land Use: <br />Exhibits: <br />I, Vicinity Map <br />2. Nartative Statement <br />Vacant <br />FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />That the variance is necessary because of exceptional or extraordinary circumstances regarding <br />the size, shape, topography, or location of the subject property; or the location of a pre- <br />existing improvement on the subject property that conformed to the zoning code in effect when <br />the improvement was constructed. <br />a. Findines: The subject propeRy is a 40' X 50' non-conYorming lot certified under <br />Lot Certification #13-95. Because the lot is a legal non confornung lot, the City's <br />Zoning Code permits the development of a single family residence on the site. The <br />applicant's request is to construct a new smgle farruly residence with a front <br />setback off of 22nd Street of 10 feet and a rear (north) setback of 6 feet 8 inches. <br />b. Conclusions: Due to the limited lot depth of the site a reasonable building <br />envelope cannot be provided while meeting building setback requirements. <br />
