Critical areas are those <br /> 6 in which existing flooding, drainage, erosion, and/or instability conditions present <br /> 7 an imminent lil<elihood of harm to the welfare and safety of the surrounding <br /> 8 cemmunity, or to the integrity of the surface or groundwater system. Development <br /> 9 shall not be permitted in these critical areas until such time as the existing <br /> 10 community hazard is alleviated and it is adequately demonstrated that the proposed <br /> i 1 development will not cause a recurrence of the problem nor the occurrence <br /> 12 of any new drainage-related problem. The City Engineer may also designate <br /> 13 as critical any areas in which comparable problems would occur in the future <br /> 14 due to any increase in volume or peal< discharge. The requirements of this <br /> 15 section shall apply regardless of any variance under Section 3, item (4) . Where <br /> 16 applications of the provisions of this section will deny all reasonable uses of <br /> �� the property, the restrictions on clevelopment contained in ttiis section rnay <br /> lg be waived for the subject property, provided tliat tlie resulting development <br /> 19 shall be subject to all the remaining terms and condition of this new Chapter <br /> Zp of the (EMC). All decisions based on the provision of this secticn shall be <br /> 21 compatible with the Comprehensive Drainage Plan for the basin in which the <br /> 22 subject property is located. For development in areas designated as critical, <br /> 23 the developer shall provide information regarding volume and rate of discha�ge <br /> 24 for a range of storms as specified in the Procedures Manual. <br /> 25 Section 7: Review and Approval of the Plan <br /> 26 Ali surface and storm drainage plans prepared in connection with any of <br /> 27 the permits and/or approvals listed in Section 3 of this Chapter shall be submitted <br /> 28 for review and approval by the City C-ngineer. <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br /> -$- <br />
