Should establishmPnt of a reeional <br /> g ' detentinn facility.at a location not contained in the subject property entail <br /> q a greater public benefit, the City C-ngineer may require the developer to participate I <br /> •tp. i in the cost of such an off-site reRional detention facilitv in lieu of const�_ucun� I <br /> �z, on-site detention facilities. Such decision shall be made concurrently witii <br /> 12 review and approval of the plan as specified in Section 7. [n the event that <br /> 13 the City decides to assume responsibility for all or any portion of the design, <br /> 14 construction, operation, and maintenance of the facilities, the developer will <br /> 15 be required to contribute a pro rata share to the construction cost of the , <br /> 16 facilities. The developer ma}• be required to supply additional information at <br /> I� the request of the City Engineer to aid in the determination by the City. <br /> Ig Guidelines for implementing this section will be defined in the Procedures Manual <br /> �g or by the City Engineer. <br /> Z� Section 9: Bonds and :,iability Insurance 2equired <br /> 21 The City [ngineer is authorized to reguire developers constructing retention/ <br /> 22 detention and/or other drainage treatment/abatement facilities serving areas <br /> 23 larger than one (l) acre to post surety bond (s). <br /> 24 Where such developers have previously posied, or are required to post, <br /> 25 other such boncis on the facitity itself or on other construction related to the <br /> 26 facility, suchperson -:iay, with the permission of the City Gnginecr and to the <br /> 2� extent allowable by law combine all such bonds into a single bond, provided <br /> 28 that at no time shall the amount thus bonded be less than the total amount <br /> 29 which would have been required in the form of separate bonds, and ��rovided <br /> 30 furiher that such a bond shall on its face dearly delineate ihose separate bonds <br /> 31 Which it is intended to replace. <br /> 32 I <br /> -9- <br />
