Since the week <br /> aft�r we closed and moved in, I have been in contacL- with Mr. William Bickle of <br /> Rich�rd Ja7es Realty (your real estate agent) about drainage problems. As part <br /> of tt•r� sale, you hired a contractor (Mr• Joe1 Bushman) �rho essentially stated i <br /> that there iaere no drainage problems. This proved to be untrue. <br /> While Mr. Bickle has assured me repeatedly that he represents you, and that you <br /> would pay to correct the problems, I have Yet to see any repairs begin. I don't <br /> W�ow whether Mr. Bickle has kept you informed of our c�versations, but I was ' <br /> not sazisfied with the last offer he relayed fran you fer one hundred dollars <br /> . ' . <br /> to cover materials. <br /> � 0�� I intend to hold either you or your consulting contractor, P1r. Bushman, liable <br /> � � for correcting the drainage problem. As I believe you are already aware, the <br /> � problem is �liat water accumulates in the crawispace, aspecially near the exterior <br /> j �o walls, wherever there is appreciable rainfall. It can get up to two or three I <br /> � � ?nches deep, and takes days or weeks to evaporate or drain away. Over time, this <br /> i exc�ssive moisture will irgvitably cause damage to the house. <br /> � ` The basis of your liabi].ity is that ��ou were aware of the water problems before <br /> I !"'� Mr. Hustanan pm��ided his "expert" opinion. This was evidenced by the fact that <br /> "� you hired someone zo use a sump p�nnp to reJnove water from the crawlspace before <br /> the Veteran's Administration (VA) inspector looked at the house. Also, the neighbors i <br /> have told me that you told them about w�+er problems during the three years that <br /> ` ��eu owned the house. In spite of your ]mowledge of these problems, you ailowed <br /> (�►� the sale to go thruugh with Mr. Bushman's incorrect eValuation. <br /> The sump pump was stili present when the VA inspector arrived, which prompted � <br /> '�o him to require a statement from a qualified source that "a sump pump is not required � <br /> i� � to assure a dry crawl space". Mr• Buslunan's statement 4ras intended to address I <br /> � this concern. It stated that a sump pump was not required because "record rainfall" <br /> ! oias tYie cause of srater accumulation, and "the original draining system" should <br /> M handle normal rain ce�ditions. This stateme�t, upon which I and the VA relied I <br /> I ��...� to ascertain the condition of the house, was rompletely wrong. <br /> \ In fact, the original drainage system is only contributing to a drainage problem � <br /> which is primarily due to the impermeable ground under the house. <br /> According to Steve Bodine of Dodine Construction (a drainage consultant/contr.actor <br /> who has done corrective �aork on other Marvelle built homes on lOth Dr. S.E.), <br /> the land upon which the house is built cor.tains heavy clay s,�il that holds water. ` <br /> His professional opinion is that an inside system of footing drains in the floor <br /> of. the crawlspace is the best solution.
