In short, he directly contradicts Mr. Aushman's opinion.
OH
(. g The drainage system in existence consists only of perforaced tubing that connecLs
C the downspouts to the stoxm drains• 't`he manner in which this system was installed
ay 3 can only Ue described as incompetent. The builder used erforated t,ibin4 and
ty ran it right next to the Eoundation on both sides of the house. While the tubing
-+ H roects to the storm dcsins, most oP the water doesn't make it that far. It
y + leaks out of the erforations in the tubing, saturates the ground nect to and
C' under the foundation, then wel.ls up into the crawlspace.
[
y yo The builder, Marvelle Construction, was obvioual.y wrong to have used perforated
tubing in suc h close proximity to the foundation. The house next door to the
north uses a similar drainage systn, but its builder (which was not Marvelle)
used non-perforated tubing. They've had no water in their crawlspace•
In order to rnrrect both the interior and the exterior drainage situations, Bodine
Construction has provided bids of $3,375 and $4,160 respectively, totaling $7,555.
Bodine is a high quality contractor and warrants their work for five years. i
I've consulted an.' attorney who has advised me of a range of legal options. vlhile
I still hope to avoid legal action, I'm at the limit of my patiEnce. The drainzge :ystem does not
1 meet the intent of the Everett city building co4e, which state that there must
be provision for taking water awa from the house. The system that Marvelle installed I
, S'1 actually channels water toward the house. You, as the original home buyer, may
still have a case against Marvelle. I only have a case against you, and I don't
plan to wait for you to settle with Marvelle.
' d`" There is also possible liability on the part of Mr. Bickle, as the representative
I '' of licensed broker Dave Duncan of Richard James Realty. Mr• Bickle was sufficiently
aWare of the problems in adrance of the sale to have counseied you about pumping
out the crawlspace, yet he chose to go along with Mr• Bushman's implausible diagnosis. .r;:k, ..;. ,
` This leads me to question whether there was de facL-o misrepresentation of known
 facts.
I sincerely hope that you wi11 do the right thing and save Ls both a lot of trouble.
'+.
