�_ <br /> (a) Setbacl�s for govemn�ental or quasi-govemmental buildings and uses located I <br /> outside the B-3 zone shall be determined during the review procQss as necessary <br /> based upon the impact and proposed use or building will have upon the surrounding <br /> properties. <br /> (EMC 19.41.150.C&D) ' <br /> 5. The existing Denney Youth Center is a non-conforming use. It is non-conforming <br /> because of the iise in the R-4 Multiple-Family High Density Zone. Its non- <br /> conformity may continue subject to the Special Property Use Permit review. (finding <br /> of fact#9) <br /> 6. The criteria for review of expansion of Non-Conforming Use Permits are established <br /> in EMC 19.38.0°0. They are: <br /> (a) The impact of traffic generated by the proposed use on the surrounding area, <br /> pedestrian circulation and pubiic safety, and the proposal's ability to mitigate <br /> potential impac±s. <br /> (b) The site has sufficient lot size to provide for off-stroet parking, landscaping, <br /> and screening from adjacent uses. <br /> (c) {l"he propossd expansio�) provides a service to the general area. <br /> (d) The adequacy of streets, utilities, and public services to accommodate the <br /> propose�J use. <br /> (e) Compatibility of proposed use or building to surrounding properties, <br /> especially as it relates to size, height, location, and setback of buildings. <br /> (f) The number, size, and location of signs, especially as they relate to more <br /> sensitive land uses. <br /> (g) The landscaping, buffering, and screening of parking, loading, and storage <br /> areas. <br /> (h) The generation of nuisance irritants such as noise, smoke, dust, odor, glare, <br /> visual blight, or other undesirable environmental impacts. <br /> (i) Consistency wit�. the goals and policies of the Everett General Plan and the <br /> purpose of the zone in which it located. <br /> (j) Consistency with the environmental policies as stipulated in the City's SEPA <br /> Ordinance. <br /> 10 <br />
