ri <br /> Whereas, the Everett City Council has recognized the need for a new animal shelter to <br /> be located at 333 Smith Island Road (the "Animal Shelter") to replace the Existing Shelter; <br /> and <br /> Whereas, Snohomish County wishes to have Everett continue to provide animal <br /> shelter services for animals from unincorporated Snohomish County at the Animal Shelter; <br /> and <br /> Whereas, by Ordinance No. 3058-08, the Everett City Council appropriated <br /> $8,400,000 to fund the capital costs of the Animal Shelter; and <br /> Whereas, Everett and Snohomish County each have the authority to build facilities for <br /> sheltering, caring for and disposing of animals and may enter into agreements with one <br /> another for joint and cooperative action pursuant to RCW 39.34.030 and RCW 39.34.080; <br /> and <br /> Whereas, animals from unincorporated Snohomish County have accounted for forty- <br /> one percent (41%) of the use of the Existing Shelter over the past ten (10) years; and <br /> Whereas, Everett and Snohomish County reasonably project that animals from the <br /> area that is currently unincorporated Snohomish County will account for forty-one percent <br /> (41%) of the use of the Animal Shelter over the next twenty-five (25) years; and <br /> Whereas, Everett is willing to expand the new shelter facility it is constructing to <br /> accommodate animals from currently unincorporated Snohomish County and from other <br /> cities or entities within Snohomish County provided that Everett's costs of providing these <br /> additional services, including the capital facilities, operations and maintenance costs, are <br /> proportionately covered by those that will use the Animal Shelter; and <br /> Whereas, in order to induce Everett to continue to provide animal shelter services for <br /> animals from unincorporated Snohomish County at the Animal Shelter and in order to meet <br /> Snohomish County's need for animal shelter services at the Animal Shelter over the term of <br /> this Agreement, Snohomish County will pay Everett forty-one percent (41%) of certain <br /> capital costs of the expanded Animal Shelter as set forth herein; and <br /> Whereas, contemporaneously with entry into this Agreement, Everett and Snohomish <br /> County will enter into an amendment to or replacement of the existing Interlocal Agreement <br /> Regarding Animal Shelter Services (the "Existing Services Agreement") to address operation <br /> and administration of animal shelter services at, and maintenance of, the Animal Shelter; and <br /> Whereas, it is anticipated that Everett will enter into separate agreements with other <br /> cities and entities within Snohomish County pursuant to which those cities and entities will <br /> make provision for their contributions to the cost of capital facilities and operations of the <br /> Animal Shelter; <br /> ANIMAL SHEL lER CAPITAL FACILITIES AGREEMENT <br /> Page 2 of 19 <br /> 9 <br />
