AGREEMENT FOR THE 2009 FASTPITCH WESTERN WORLD <br /> SERIES TOURNAMENT <br /> This Agreement is by and between the National Softball Association("NSA") whose <br /> address is NSA Western Zone, 1200 Mission Del Mar Way, Las Vegas, NV 89123, and <br /> the City of Everett("City"), a Washington municipal corporation whose address is 2930 <br /> Wetmore Avenue, Everett, Washington, 98201. <br /> WHEREAS, the National Softball Association considered Western Washington as the <br /> site of the 2009 Girls Fastpitch Western World Series Tournament("Tournament"); and <br /> WHEREAS, the Tournament is estimated to attract 250-300 division A and B teams, <br /> consisting of ages 10 and under through 18 and under, with 12-16 players per team, in <br /> addition to family members,Tournament officials and umpires who will need lodging, <br /> food and other services during their stay in Everett and the greater Everett area; and <br /> WHEREAS, the City recognizes the tourism and economic benefits of hosting the NSA <br /> Tournament and providing fields for Tournament play; and <br /> WHEREAS, City operates, maintains and schedules playing fields; <br /> WHEREAS, the City is willing to help host the Tournament on its playing fields; <br /> NOW THEREFORE, in consideration of the premises and the mutual promises contained <br /> herein, the parties agree as follows: <br /> 1. TOURNAMENT <br /> The NSA will conduct its 2009 Fastpitch Western World Series Tournament <br /> ("Tournament") on City ball fields as provided in this Agreement. The Tournament will <br /> be held from Monday, July 20, 2009 through Saturday, July 25, 2009 at Phil Johnson <br /> Ballfields and from Tuesday, July 21, 2009 through Saturday, July 25, 2009 at Kasch <br /> Park. <br /> 2. SCHEDULE <br /> A. Field use is available and scheduled as listed on Attachment A. NSA shall provide the <br /> City with a Tournament schedule in writing by Monday, June 22, 2009. Changes in field <br /> schedules must be approved by the City. If requested schedule changes require additional <br /> City resources,the City will charge NSA the cost of the additional work. <br /> B. Games will not start earlier than 8 a.m. and must be completed no later than 11:00 PM. <br /> C. Any use of fields by NSA, including warm-up play, will not be allowed unless City <br /> staff is onsite. <br /> 0 <br /> - 1 - <br />
