J <br /> C. SAFETY <br /> NSA shall be responsible for the safe operation of the Tournament. NSA shall inspect <br /> the fields prior to and during the Tournament and shall satisfy itself that the fields are <br /> appropriate for NSA play. The City does not warrant or represent the adequacy or safety <br /> of the fields. NSA shall notify the City of any concerns or hazards at both sites prior to <br /> any games being scheduled or played. NSA shall have a written safety plan whose <br /> elements must include first aid, emergency medical response, crowd control, and <br /> spectator safety. NSA shall provide such safety plan to the City at least thirty days in <br /> advance of the start of the Tournament and shall make such reasonable changes and shall <br /> supplement the plan if requested by the City. NSA shall stop play on a particular field if <br /> continued safe play is not reasonably likely for any reason, such as unruly crowds or <br /> unsafe weather or field conditions. NSA shall have sole responsibility for determining <br /> whether games may be safely played. <br /> D. PROPERTY <br /> NSA shall be responsible for any and all damage to City-owned property from NSA's <br /> Tournament. NSA shall leave and/or return properties in the same or better condition at <br /> the conclusion of the Tournament. Photographic documentation and field determinations <br /> shall be used to establish before and after conditions. <br /> 7. ADMISSION <br /> NSA will not charge an admission fee. <br /> 8. CONCESSIONS <br /> A. MERCHANDISE AND SOUVENIRS <br /> NSA may sell merchandise and souvenirs and retain all proceeds from such sales. NSA <br /> will be provided space at a designated location as determined by City staff. The City will <br /> not provide facilities, or personnel for the sale of merchandise and souvenirs. NSA shall <br /> approve all merchandise vendors and provide a list of approved vendors to City in <br /> advance of the Tournament. The City reserves the right to eject merchandise vendors <br /> who, in the reasonable opinion of the City are inappropriate for a girls fastpitch <br /> Tournament, who violate City, state or federal laws or regulations, or who engage in <br /> misconduct during the Tournament(e.g., engaging in shouting matches with other <br /> vendors). <br /> B. REFRESHMENTS <br /> Only the City or the City's contractor(s)may sell food and drink. Proceeds from such <br /> sales shall be retained by the City, or distributed pursuant to the City's agreement with <br /> any contractor(s). Concession stands will be open daily one hour prior to first game and <br /> stay open through the end of the final game each day. <br /> 13 <br /> - 5 - <br />
