ti <br /> CITY OF EVERETT <br /> AMENDMENT NO. 1 <br /> The City of Everett and Jones & Stokes Associates, Inc. (ICF Jones & Stokes, Inc.) agree to <br /> amend and modify their professional services agreement dated October 8, 2007 (the <br /> "Agreement") as follows: <br /> WHEREAS, Jones & Stokes Associates, Inc. and the City entered into an agreement dated <br /> January 16, 2007 to provide Smith Island Intertidal Mitigation Monitoring services for the Smith <br /> Island/Union Slough Restoration project; and <br /> WHEREAS, the City of Everett requires continued assistance in performing the required <br /> mitigation monitoring for the Smith Island/Union Slough Restoration project;and <br /> WHEREAS, the total amount of compensation of$150,134 stated in the agreement is <br /> insufficient for the additional work at Smith Island and an additional $93,242 of contract value is <br /> needed to perform the additional work for a total of$243,376; <br /> WHEREAS, the City of Everett and Jones & Stokes Associates, Inc. agree to amend their <br /> Agreement to extend the time of completion from January 31, 2009 to January 31, 2010; and <br /> NOW THEREFORE, the City of Everett and Jones & Stokes Associates, Inc. agree to amend <br /> and modify the Agreement as follows: <br /> 1. The additional work as described in Attachment 1 is added to the Scope of Work <br /> described in Exhibit A of the agreement. <br /> 2. Paragraph 3 of the Agreement is amended to read as follows: <br /> Time of Beginning and Completion of Performance. This Agreement shall commence <br /> as of the date of execution of this Agreement and shall be completed by January 31, <br /> 2010. <br /> 3. Paragraph 4(D) is modified to read as follows: <br /> Total compensation, including services and expenses, shall not exceed a <br /> maximum of Two Hundred Forty Three Thousand Three Hundred Seventy Six <br /> Dollars ($243,376). <br /> 46 <br />
