.�9 <br /> f; The Association may also offer as long as it doesn't conflict with Everett Parks' <br /> recreational Rowing Program, a Junior Crew competitive program to be open to <br /> all Everett area youth. <br /> g. Provide for the collection and accounting of all revenue and expenditures <br /> including,but not limited to,membership fees,regatta entry fees donation, and all <br /> other revenue obtained and expenditures incurred, from the operation of the <br /> Association's program. The Association shall not be responsible for collecting <br /> and accounting for revenue for Parks Department recreational rowing classes <br /> taught by the Association. In connection with the collection of revenue,the <br /> Association agrees to maintain an accurate accounting of all revenue collected <br /> based on generally accepted accounting principles,and to keep said books open <br /> for inspection by the City at any reasonable.time. The Association shall also <br /> provide a fiscal year end fmancial statement to the City,on or before October 31st <br /> of each year of the Agreement. <br /> h. Pay all other costs associated with the operation of the program,including, but not <br /> limited to,the payment for officials,instructors,coaches,trophies,printing costs <br /> and supplies. <br /> i. Provide a minimum of one launch and an adequate amount of gas available for <br /> use by Association members at all times a shell is in use. <br /> j. Provide adequate and appropriately trained adult supervision for all events. <br /> k. Provide group membership in U.S. Rowing Association or its equivalent as <br /> approved by the City to cover all people rowing out of the shellhouse. <br /> I. Shellhouse facility and all appurtenances are the sole property of the City. The <br /> Association may not change, modify, or upgrade the structure or building in any <br /> way without advance written approval by the City, (to include painting,additions, <br /> utilities modification or any other activity that permanently changes the facility). <br /> m. That pursuant to availability as discussed in Section 2(d),the Association agrees <br /> to obtain a release of liability prior to allowing non-Association owned watercraft <br /> to be stored in the boating facility. Said release shall be in the form of the Everett <br /> Rowing Association and Personal Boat Owners Boat Stowage Agreement for <br /> Privately Owned Craft. Said agreement must be provided to City,along with all <br /> other referenced attachments in Exhibit B,within 30 days of agreement execution. <br /> n. Operate in a safe and prudent manner and comply with applicable federal, state <br /> and City ordinances,rules and/or regulations. <br /> o. Pursue funding for safety equipment, and use 10% of gross revenue(excluding <br /> the Junior Program revenue)for such purchases annually. Such safety related <br /> purchases and expenditures will be identified at the annual meeting. <br /> p. No duplicate keys will be made. Only personnel authorized by the Association <br /> will keep keys. Association members needing a key must request the keys <br /> through the Everett Parks' representative appropriate Association authorization <br /> and payment of standard key deposit. The Parks Department will keep a list of <br /> current key holders and will provide it to the Association upon request. <br />
