GTE was the previous owner of the <br /> building and was operating an'internet communications facility there when the City purchased the site in <br /> 1999. Subsequent to the sale,GTE became a tenant in the building. The initial term of their lease was <br /> through August 2008 with options for 3 renewal terms of 5 years each. <br /> In an oversight,Level 3 failed to provide the required 180 days advance notice to exercise their first option to <br /> renew and are currently occupying the space under the"hold over"provision of the lease. <br /> This proposed amendment consents to the first 5 year renewal term and reinstates all other terms of the lease <br /> not specifically altered by the amendment. <br /> RECOMMENDATION: <br /> Authorize the Mayor to sign the Lease Renewal Amendment No. 1 for Level 3 Communications LLC <br /> renewing their lease of space at 1121 SE Everett Mall Way. <br /> 25 <br />
