Obtain a grading and filling permit from the Public <br />Works department. NOTE: Any development of an environ- <br />mentally sensitive area will require an environmental <br />review. There are restrictions which may prohibit <br />filling a wetland. <br />3. If you intend to expand the auto repair activity at <br />this site, you must obtain a permit for the expansion <br />of a non -conforming use which is subject to revie,., <br />process III.B., Hearing Examiner Review of the Everott <br />Zoning Code. <br />4. The Army Corps of Engineers' report and other photogra- <br />phical documentation indicate that at least one half <br />acre of land (including an environmentally sensitive <br />wetland), have been graded and filled. The land that <br />has been designated an environmentally sensitive must <br />be restored. <br />The process for restoration of the wetland shall in- <br />clude the submittal of a restoration/revegetation plan. <br />The plan shall be prepared by an expert wetlands biolo- <br />gist and shall also include a schedule for the timely <br />completion of the restoration. <br />We ask that you respond to this letter with your intentions <br />for the correction of the violations by no later than June <br />18, 1990. Should you care to meet and discuss a complete <br />compliance schedule, please call me at 259-8731. <br />Failure to respond or to correct these 'violations will <br />result in criminal proceedings as provided for in the <br />aforementioned codes. <br />Also, in response to your earlier request to check the <br />drainage problems that exist on your property, a public <br />works inspector has inspected the area and submitted her <br />report. It states that the development to the south of your <br />land has had minimal, if any effect on your property. <br />According to the soil samples and vegetation reports, the <br />wetland that is present on your land has been in existence <br />for at least 50 years. <br />
