"I <br />r <br />r <br />L <br />AND WHEREAS, after proper notice was given as required by law, the City of <br />Everett Land Use Hearing Examiner held a public hearing on April 16, 1981, and after <br />considering all evidence elicted durii g the public hearing; evidence submitted by the <br />applicant; and after a personal inspection of the subject property and surrounding area, <br />the Hearing examiner on July 1, 1981, made a recommendation to City Council that the <br />Special Property Use Permit, as applied for by St. Mary Mag,'alen Parish to allow <br />construction of a 13,900 square foot addition consisting of five permanent classrooms to <br />replace five portable classrooms and the addition of a new science room, library, and <br />office be granted subject to conditions; and <br />WHEREAS, the Everett City Council concurred with the Heari.-,g Examiner's <br />recommendation at its regular meeting on July 22, 1981, <br />3. <br />4. <br />5. <br />6. <br />NOW, THEREFORE, said permit is granted with the following conditions: <br />10 feet of additional right-of-way should be dedicated along, Seventh Avenue. <br />Civil Engineering plans submitted to the Public Works Department must show <br />abutting public right-of-way and additional dedication as required by the City <br />Ordinance. <br />A covenant to formation of a Local Improvement District shall be provided for <br />future improvements to public right-of-way on Seventh Avenue and 88th Street S.E. <br />The design of temporary pedestrian improvements that are required on 88th Street <br />S.E. and on Seventh Avenue shall be approved by the City Transportation Engineer. <br />On -site detention is required with drainage calculations to be submitted on the City <br />Drainage Submission Form. <br />Drainage systems from the site must be developed to collect and transfer storm <br />water to existing systems by approved methods. <br />7. A temporary erosion control plan shall be submitted by the Applicant and approved <br />by the Public Works Department prior to the commencement of earth work on the <br />site. All reseeding of exposed earth is required within 30 days of completion of the <br />earth work. <br />8. Participation in the funding of the South End Sewer Interceptor is required. The <br />approximate cost based on the preliminary information provided is $9.86 per <br />student, based on design capacity. Credit will be given for the existing student <br />load. The acutal cost shall be computed by the Building Department per the <br />Ordinance in effect at the time and according to the information provided on the <br />approved plans on the date of permit issuance. <br />19.
