2. Washington DepaRment of Fish and Wiidlife (WDFW) has commented tiiat the preferred option for <br />the stream crossing would be a bridge. li a culvert option is considered, it must be fish passabie, <br />unless otherwise determined by WDFW. WDFW will require that appropriate mitigation be used for <br />the impacted riparian wetiand areas. Any questions should be directed to Ginger Holser, Area <br />Habit,at Biologist at WDFW at 425-379-2305. <br />MITIGATION OF ADVERSE IMPACTS BY SEPA <br />1. Any grading/fill on this site shall be done so as to not impact the surrounding properties. (SEPA <br />Earth, Land and Shoreline Use Policies.) <br />2. The Mukilteo School District has commented that the project will adversely impact the School <br />District. The app��cant and the School District have reached a mitigation agreement. Prior to <br />issuance of building permi!s, execution of the agreement is required, and payment to the School <br />District shall be made. (SEPA Public Services and U!�iities Policies) <br />The lead agency for this proposai has determined that it does not have a probable significant adverse <br />iinpact on the environment. An Environmental Impact Statement is not required under RCW <br />�3.21 C.030(2)(c). This determination assumes compliance with State law and City ordinances related to <br />general environmental protection including but not limited to right-of-way improvement requirements, <br />drainage, etc. This decision was made after review of a completed environmental checklist and other <br />information on file with the lead agency. This information is available to the public on request. This <br />Mitigated Determination of Non-Significance is specifically conditioned on compliance with the conditions <br />attached hereto wnich are incorporated by reference as if fully set foRh herein. <br />This Final MDNS is issued under WAC 197-11-355. This land use permit shall terminate if appiicant does not apply for a building permit within 1 S months <br />(or, with an extension, 24 months), except where a time limit on the land use permit is otherwise <br />established under federal or state law, city ordinance, or an executed development agreement. <br />
