V <br />The Mukilteo School District has commented thai the project will a�+versely impact the <br />School District. The Applicant has negotiated with the School Distric[ regarding a <br />mitigation agreement. Prior to the issuance of any Pubiic Works and/or Building Fermits <br />die Applicant must submit a letter from the Mukilteo School District confirming payment <br />of the agreed upon mitieation fee of $23.339.84 per the mitigation agreement dated July <br />20, 1998. <br />4. WETLANDS: <br />Project Site Descrip(ion <br />The development site is approximately 1.65 acres and is located at the SE corner of <br />IOOtI� Street and 9th Avenue West. A site specific investigation on May 10, 1997 <br />identified a 3,550 SF isolared depressional wedand along the western i m� 1 of the <br />properry. Much disturbance has occurred on this site within the last fivP �5) years <br />including clearing, filling and grading. Vegetation on the site is typir.al of extremely <br />disturbed sires within the City of Everett. A few mamre alder trees remain around the <br />perimetcr of the properry. Dominant vegetation located along the western haif of the site <br />iaclude Pioneer Red Alder, Black Cottonwood, Willows, Scots Broom, Soft Rush and <br />Himalayan Blackberry. A perched water table is the major source of wetland hydrology. <br />Wetlanc! hydrology appears to have been historically impacted by the develo2ment of <br />surrounding properties. This wedand is in the Swamp Creek Water Shed. Very litde <br />vegetation is rooted in the wedand. The buffer area around the wedand is dominated by <br />Red Alder with a few Wesrern Red Cedar and Wesrern Hemlock trees. According to the <br />US Fish and Wildlife Service (USFWS) classification system (Cowarding et al 1979) this <br />wetland would be classified as Palustrini: Scrub-Shrub, Broad-Leafed Deciduous, <br />Saturated. Under the City's ESA Ordinance NO. 1939-91 this wedand is cl�ssified as a <br />Category II with a minimum fifry (50) foot protective buffer. <br />II. Froposed i�litigation Plan <br />As part of the development proposal to construct thirty-two (32) multiple family units at <br />the SE corner of IOOth Street and 9th Avenue West, a 3,550 SF scrub/shrub Category III <br />wedand along the west side of Lots 1 and 2 will be filled. The wedand/buffers on Lots 1 <br />and 2 have been ranked low in a functional value assessment for water qualiry <br />improvement, storm and tlood water storage, ground warer recharge/discharge, noise anc <br />visual screenine and biological s�ipport. (Critical Amas Report, S. R. Jay Consulting, <br />June 3, 1997) <br />Section 37.110.C.S.b.ii of the City's ESA Ordinance mquires a 1.5:1 mitigation ratio for <br />impacts to Class III wedands. Wetland mitigation will not he possible on Lots 1 and 2 <br />and the applicant is proposine off-site mitigation. Wedand mitieation is proposed oif-site <br />on Lot 20 which is kitry-corner from Lot 2 on the west side of 9th Avenue West. A <br />4,725 SP Class 1[I wetland is lo.ated along the west side of Lot 20. Approximately <br />2, IZS SP of the wetland on Lo'. 20 has been impacted by the placement of illegal fill to <br />the east and development activities on the rroperry located to the west within ten (10) <br />feet of the wedand ed,e. <br />The applicant has submitted a Final Mitigation Plan by S. R. Jay Consulting dared June <br />3, 1997 and revised on November 18, 1997 and July'_1, 1998. The ge��l of the Final <br />Revised Wedand Mitieation Plan. dated July 21, ]998, is the restoracion and/or creation <br />of ]0,700 SP of we[!and for previous weUand impacts on Lot 20 and the proposed filling <br />of the �vedand on Lots I and 2. <br />
